{ <br /> } <br /> INTRODUCED BY: Mr. Sharpe DATE: February 13, 2012 <br /> BILL NO.: 9149 ORDINANCE NO.: 6882 <br /> s <br /> AN ORDINANCE DECLARING 8342 DELCREST DRIVE REDEVELOPMENT <br /> AREA BLIGHTED UNDER THE LAND CLEARANCE FOR REDEVELOPMENT <br /> AUTHORITY LAW; APPROVING A REDEVELOPMENT PLAN FOR THE AREA; <br /> AND FINDING THAT THE REDEVELOPER IS QUALIFIED FOR TAX <br /> ABATEMENT. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, <br /> MISSOURI, AS FOLLOWS: <br /> WHEREAS, conditions exist which endanger life or property by fire or other causes and <br /> constitute an economic or social liability or a menace to the public health, safety, morals or <br /> welfare in the present condition and use of 8342 Delcrest Avenue; and <br /> WHEREAS, such conditions are beyond remedy and control solely by regulatory <br /> process in the exercise of the police power and cannot be dealt with effectively by ordinary <br /> private enterprise without the aids provided in the Land Clearance for Redevelopment Authority <br /> Law contained in Sections 99.300 to 99.600 RSMo. ("LCRA Law"); and <br /> WHEREAS, there is a need for the Land Clearance for Redevelopment Authority of <br /> University City ("LCRA"), a public body corporate and politic created under Missouri law, to <br /> undertake the development of the above described parcels as a land clearance project under <br /> the LCRA Law, pursuant to plans by or presented to the LCRA under Section 99.430.1(4) <br /> RSMo.; and <br /> WHEREAS, Delcrest Apartments, LLC ("developer") for 8342 Delcrest Drive has <br /> prepared a blighting analysis (the "Blighting Analysis") for 8342 Delcrest Drive (the "Area") dated <br /> December 20, 2011, and a Redevelopment Plan ("Plan") for the Area dated November 8, 2011 <br /> and presented both to the LCRA on January 17, 2012; and <br /> WHEREAS, a general plan has been prepared and is recognized and used as a guide <br /> for the general development of the City, known as the 2005 Comprehensive Plan Update (the <br /> "Comprehensive Plan"); and <br /> WHEREAS, the LCRA has considered the Blighting Analysis and Plan prepared and <br /> presented by the developers, found that the Plan conforms to the Comprehensive Plan, and has <br /> recommended the Plan to the Plan Commission of the City ("Plan Commission") and to the City <br /> Council of the City ("City Council"); and <br /> WHEREAS, the Plan Commission has advised the City Council that the Plan conforms <br /> to the Comprehensive Plan, and the Plan has been presented and recommended by the LCRA <br /> and Plan Commission to the City Council for review and approval; and <br /> WHEREAS, under the provisions of Section 99.430 RSMo., the City Council may take <br /> such actions as may be required to approve the Plan; and <br /> WHEREAS, it is desirable and in the interest of the public's health, safety and welfare <br />
