that a public body, the LCRA, undertake and administer the Plan in the Area; and <br /> WHEREAS, the LCRA and Plan Commission have made and presented to the City <br /> Council the reports, statements, and certifications required to be made and submitted by <br /> Section 99.430 RSMo., and the City Council has been fully apprised by the LCRA and Plan <br /> Commission of the facts and is fully aware of the conditions in the Area; and <br /> WHEREAS, the City Council has duly considered the reports, recommendations, and <br /> certifications of the LCRA and the Plan Commission; and <br /> WHEREAS, in accordance with the requirements of Section 99.430 RSMo. the City <br /> Council advertised that it would hold a public hearing on the Plan; and the City Council held said <br /> hearing at the time and place designated in the advertisement, and all those who were <br /> interested in being heard were given a reasonable opportunity to express their views; and <br /> WHEREAS, the City Council now desires to take appropriate official action respecting <br /> the approval of the Plan; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> UNIVERSITY CITY AS FOLLOWS: <br /> SECTION ONE. Blighting Determination. The Blighting Analysis of the area is <br /> attached and incorporated as Exhibit 1". The City Council finds and declares that the 8342 <br /> Delcrest Drive is a "blighted area," as defined by Section 99.320 of the LCRA Law, by reason of <br /> predominance of unsanitary and unsafe conditions, deteriorated or inadequate site <br /> improvements, improper subdivision or obsolete platting, conditions which endanger life or <br /> property by fire or other causes and constitute an economic or social liability or a menace to the <br /> public health, safety, morals or welfare in the present condition and use of the Area. <br /> SECTION TWO. City Council's Plan and Redeveloper Determinations The <br /> Redevelopment Plan for the Area ("Plan") is attached as Exhibit "2" and incorporated by <br /> reference. The City Council finds and declares as follows: <br /> (a) The Area qualifies as an area in need of redevelopment and that the <br /> redevelopment of the Area is necessary and in the interest of the public health, <br /> safety, morals and general welfare of the people of the City, all as permitted by <br /> and provided in the LCRA Law; <br /> (b) The Plan is feasible and conforms to the City's Comprehensive Plan; <br /> (c) The Plan contemplates new construction or rehabilitation of the designated real <br /> property in the Area; <br /> (d) The Plan, having been duly reviewed and considered by the City Council, the <br /> Plan Commission, the LCRA, and their respective officers and staff, is hereby <br /> approved; and <br /> (e) Delcrest Apartments, LLC is hereby declared the redeveloper (the <br /> "Redeveloper") for implementation of the Plan in accord with the LCRA Law. <br /> SECTION THREE. Relocation Assistance. The property within the Area is currently <br /> unoccupied. The Plan for the Area provides that no families will be displaced as a result of the <br /> Plan. If the property within the Area should become occupied, all eligible occupants displaced <br /> by the developer shall be given relocation assistance by the developer at its expense, in <br /> accordance with the Plan and all applicable federal, state and local laws, ordinances, <br /> regulations and policies. <br />
