1 <br /> A. That the Contract adequately provides for the redevelopment of the <br /> Property to LEED-certified standards and otherwise presents, in conformity with the City's 3 <br /> general comprehensive and development plans, a coordinated, adjusted and harmonious <br /> development of the Property that will promote the health, safety, morals, order, convenience, <br /> prosperity and general welfare of the City and its residents; <br /> B. That the Property would not be redeveloped, either now or in the <br /> foreseeable future, by private parties absent the transfer of the Property by the City to the <br /> Developer; <br /> C. That the redevelopment of the Property by the Developer justifies the <br /> conveyance of the Property to the Developer by the City at no cost to the Developer; and <br /> D. That the Contract contains adequate provision for the return of the <br /> Property to the LCRA or the City if the Developer fails to redevelop all or part of the <br /> Property. <br /> Section 2. The City Manager is hereby authorized and directed to execute and deliver <br /> the Property to the Developer on behalf of the City and to otherwise take any and all actions <br /> as may be deemed necessary or convenient to carry out and comply with the intent of this K <br /> Ordinance. <br /> t <br /> Section 3. The sections of this Ordinance shall be severable. If any section of this t' <br /> Ordinance is found by a court of competent jurisdiction to be invalid, the remaining sections <br /> shall remain valid, unless the court finds that: (a) the valid sections are so essential to and <br /> inseparably connected with and dependent upon the void section that it cannot be presumed <br /> that the City Council has or would have enacted the valid sections without the void ones; and <br /> (b) the valid sections, standing alone, are incomplete and are incapable of being executed in <br /> accordance with the legislative intent. <br /> g <br /> Section 4.
