i <br /> 1 <br /> I <br /> INTRODUCED BY Mr. Sharpe and Mr. Price DATE: November 13, 2012 1 <br /> 1 <br /> BILL NO 9168 ORDINANCE NO 6901 <br /> 1 <br /> I <br /> AN ORDINANCE AMENDING CHAPTER 8.24, NUISANCES, OF THE MUNICIPAL <br /> CODE OF UNIVERSITY CITY BY ENACTING NEW DEFINITIONS, BY <br /> REPEALING SECTIONS 8.24.260 AND 8.24.270, AND BY ENACTING IN LIEU <br /> THEREOF A NEW SECTION 8.24.260, PROVIDING FOR THE DECLARATION, <br /> PROSECUTION, AND ABATEMENT OF CRIMINAL NUISANCES. <br /> i <br /> WHEREAS, Sections 8.24.260 and 8.24.270 of the University City Municipal Code <br /> address nuisances that are created by the use of private property for the illegal sale and use of <br /> controlled substances and other criminal activity; and <br /> WHEREAS, said sections overlap in some respects, and their abatement standards <br /> and procedures are sometimes not clear or are lacking in constitutional due process <br /> protections; and <br /> r <br /> WHEREAS, the City Council desires to consolidate these sections, clarify the t <br /> standards and procedures to be met and followed for declaring, prosecuting, and abating such <br /> nuisances, and so provide a more efficient and reliable means of enforcement; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF UNIVERSITY <br /> CITY,AS FOLLOWS: <br /> Section 1. Section 8.24.010 of the Municipal Code of the City of University h 1 <br /> City, Missouri, is hereby amended by the enactment and addition of the following two <br /> definitions: <br /> Chapter 8.24 Nuisances <br /> Title I General Provisions <br /> i <br /> I <br /> Section 8.24.010 Definitions, Generally <br /> "Owner" means: (i) the person or entity whose name is listed as the owner of <br /> premises on the last deed recorded at the St. Louis County Recorder of Deeds <br /> Office and on the last tax records maintained at the St. Louis County l <br /> Assessor's and Collector's Office, and (ii) when necessary and appropriate, <br /> any person in the care, custody, or control of premises, including any tenant, <br /> occupant, or transient user thereof, and any agent, servant, or abettor of such <br /> II <br /> person. <br /> t <br /> r <br /> "Premises" means any parcel of real property, any building or structure 1 <br /> located on real property, any personal property, such as a car, trailer, camper, <br /> etc., and any portion of the public way that abuts or supports such premises k <br /> when it is used in conjunction therewith for the commission of nuisance <br /> activity. <br /> Page 1 of 7 <br /> i <br /> t <br />
