E1 INTRODUCED BY: Mr. Sharpe DATE: October 28, 2013 BILL NO 9213 ORDINANCE NO 6944 { AN ORDINANCE AMENDING CHAPTER 6.08 OF THE UNIVERSITY CITY MUNICIPAL CODE, RELATING TO DOGS, BY REPEALING SECTION 6.08.215 THEREOF, RELATING TO DOG PLAY AREAS, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 6.08.215 DOG PLAY AREAS", THEREBY AMENDING SECTION 6.08.215 SO AS TO CHANGE THE ANNUAL LICENSE FEE FROM THIRTY ONE DOLLARS ($31.00) FOR EACH DOG TO FORTY DOLLARS ($40.00) FOR THE FIRST DOG AND TWENTY DOLLARS ($20.00) FOR EACH ADDITIONAL DOG. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UNIVERSITY CITY, MISSOURI, AS FOLLOWS: Section 1. Chapter 6.08 of the University City Municipal Code, relating to dogs, is hereby amended by repealing Section 6.08.215 thereof, relating to dog play areas, and enacting in lieu thereof new sections to be known as "Section 6.08.215 Dog play areas", so that said section, as so amended, shall read as follows: 6.08.215 - Dog play areas. A. Notwithstanding Section 6.08.210, the city manager may designate an area of city property for off-leash dog use if the city manager determines that there is a need for such an area and it will be maintained so as not to create a nuisance. The area shall be known as a "dog play area." B. Use of a dog play area shall be subject to rules and regulations established by the city manager to promote the health, safety and welfare of dog play area users and the general public. C. Only dogs licensed by the city to use the dog play area shall be permitted therein. D. The annual license fee for a resident to use a dog play area shall be forty dollars ($40.00) for the first dog and twenty dollars ($20.00) for each additional dog, which shall be in addition to the annual dog license fee required by Section 6.08.030. The dog tag issued to the applicant and worn by the dog as required by Sections 6.08.040 and 6.08.050 shall indicate that the dog is permitted to use the dog play area. E. The annual license fee for a nonresident to use the dog play area shall be sixty dollars ($60.00) for the first dog and thirty dollars ($30.00) for each additional dog. The provisions of Sections 6.08.030 through 6.08.050 applicable to residents shall apply to nonresidents, except for the annual fee imposed on residents.
