Session 1258, Minutes Page 10
September 22, 1980

Mr. Kelley asked if there was a possibility the restaurant might close if it is not
granted a liquor license. Mr. Ferrara said the property was bought with the hope
that a liquor license would eventually be granted. He said there were no plans to
move, but he could not guarantee the restaurant would stay in University City if the
liquor license is not granted, although he would like to remain here.

Mr. Lieberman asked Mr. Ferrara if he would give some kind of guarantee that the
restaurant would not have a sitdown bar, and Mr. Ferrara said he would give whatever
assurance the Council wanted, that he had no intention of having a sitdown bar, and
in fact felt it would be detrimental to the business.

Mr. Joel Iskowitch, 8216 Gannon, asked to address the Council. He said there has
been an increase in trash and rodents since the restaurant opened (13 years ago),
and he was also concerned about parking problems, even though Rich and Charlie's
bought the lot next door to create extra parking. Mr. Iskowitch said the people at
the meeting are not anti-liquor; they merely wish to keep their neighborhood resi-
dential in character.

Mr. Arthur B. Wells, 8332 Cornell, asked to address the Council. Mr. Wells said he
was in favor of the license being granted to Rich and Charlie's, that it was a fine
establishment, and an increase in business would be good for the City in terms of
more taxes being paid, and in terms of bringing more people into the City. He sug-
gested that they rent additional space across the street for their expansion.

Mr. G. P. Ferguson, 553 Westview Drive, asked to address the Council. Mr. Ferguson,
a 21-year resident, said he had been opposed eight years ago when Rich and Charlie's
first applied for a liquor license, and he is still opposed, feeling it would be a
detriment to the neighborhood.

Ms Iris Cunningham, 558 Mapleview Drive, asked to address the Council. Ms Cunning-
ham said other Rich and Charlie's have more available parking space than the one in
University City, and residents do not live in close proximity as they do here. She
said the neighbors wished to keep their neighborhood just as it is, and Rich and
Charlie's just as it is now.

Mr~ Larry Lee Kessler, 8155 Gannon Avenue, said this is now a nice residential neigh-
borhood and many citizens do not wish to see it changed. He said there have been
difficulties already, namely the parking, traffic congestion, noise, pollution and
lack of maintenance on a strip of land between Delmar and Gannon, where the grass is
quite high. He said middle of the night trash pickup also disturbs him. Mr. Ollen-
dorff said that would be looked into, since there are restrictions as to when trash
can be picked up.

Mr. Ken Leutwiler, 1114 Westmoor Place, asked to address the Council. Mr. Leutwiler
was in favor of the liquor license being given to Rich and Charlie's. He said he
enjoyed eating at the restaurant very much and felt the proprietor should be given a
fair chance to earn a living, and to compete with other restaurants. He also said
as the owner of the building across the street from Rich and Charlie's, he would
have no objection to patrons of the restaurant parking on his lot in the evenings or
on weekends.

Mayor Mooney closed the public hearing at 10:17 P.M.
