Session 1258, Minutes Page 9 <br />September 22, 1980 <br /> <br />Mr. Adams clarified the point that this proposed legislation did not originate with <br />the Council--a number of businesses in the loop proposed that the special business <br />district be established, and it was they who did the necessary work to bring this <br />about. <br /> <br />Mrs. Metcalfe said she thought Mr. Bigner's suggestion was excellent, and asked <br />that some kind of review mechanism be included in the proposed legislation. Mr. <br />Ollendorff said that would be looked into and the alternatives reported back to <br />Council. <br /> <br />Mayor Mooney closed the public hearing at 9:33 P.M. <br /> <br />PUBLIC HEARING - LIQUOR LICENSE APPLICATION, 8213 DELMAR <br /> <br />The City Manager said a public hearing was scheduled for 8:00 P.M. to consider an <br />application for a license to sell liquor by the drink at Rich and Charlie's Pasta <br />House at 8213 Delmar. All City ordinance requirements have bee~ met. The City <br />Manager said he recommended approval, following the public hearing. <br /> <br />Mr. Frank Bussman, 8123 Teasdale, asked to address the Council. He said although <br />Rich and Charlie's is a very fine restaurant,l he and others in attendance are op- <br />posed to the granting of a liquor license to them for the following reasons--con- <br />cern for the safety of school children who pass this location, lack of adequate <br />parking, increase in noise in the evening hours, possible decrease in property <br />values and fear of change in present clientele. Mr. Bussman said this was primar- <br />ily a residential area and he didn't see a need for liquor to be served here, as <br />there are a number of other places in the vicinity that serve liquor. <br /> <br />Mayor Mooney said Rich and Charlie's would still have to serve a high percentage <br />of food with the liquor, should they be granted a license. He noted that there had <br />not been any serious incidents involving drinking (patrons may now bring their own <br />liquor into the restaurant) for which police had to be called in the last five years. <br />Mr. Bussman said he felt the nature of the place would change if'~l~quor were served <br />rather than being brought in. <br /> <br />Mr. Adams said Mr. Bussman seemed to be saying that a restaurant granted a liquor li- <br />cense may become more of a bar than a restaurant, and he asked Mr. Bussman to give <br />him an example where that happened. Mr. Bussman could not think of an example at the <br />moment. Mayor Moohey noted that several restaurants in University City had been <br />granted liquor licenses recently, and that has not happened. <br /> <br />The applicant, Mr. John Ferrara, 7240 Westmoreland, was asked to come forward. Mr. <br />Ferrara said there would be a service bar, but not a sitdown bar, and there would not <br />be a "Happy Hour." He said the Rich and Charlie's restaurants are all primarily fam- <br />ily restaurants, and all of them except the one in University City sell liquor by the <br />drink. He said the concern for children passing after school was his also, but that <br />there is very little business between the hours of 2:00 to 5:00 P.M. when children <br />would already be home. He noted that other Rich and Charlie's restaurants serve 80% <br />food and 20% liquor. Mr. Ferrara said the restaurant hours would not change, and he <br />did not feel the noise level would increase or that parking would become difficult. <br />He said none of the people who signed the petition in opposition had called him to <br />find out how the liquor was to be served, and he felt many of them signed because <br />they thought there would be a sitdown bar, which will not be the case. <br /> <br /> <br />
