Session 1258, Minutes Page 16 September 22, 1980 Mr. Ollendorff said this bill approximately doubles fees for various types of in- spections, and adds application fees. This was done in order to bring those fees more into line with the actual cost. Mr. Sabol had several changes he wanted made. He moved that the application fee for a Residential Occupancy Certificate (3.1-k.) be set at $7.50 instead of the recommended $5.00. Mrs. Thompson seconded the motion. Brief discussion ensued, and it was-noted that this change would raise this fee from $2.00 (now in effect) to $7.50. Mrs. Thompson withdrew her second. The motion died for lack of a second. Under 3.2 Building Permit Eees, Mr. Sabol moved that fees for above-ground swimming pools (d) be changed from $5.00 to $10.00. There was no second. Mr. Sabol asked about an item on page 6 under 3.6 Other Fees (c), having to do with a notice of code violation, including reinspection at the end of the notice period. It was determined that this fee ($20.00) is assessed only after a letter outlining the code violation is sent, and after a predetermined waiting period has gone by and corrections have not been made. Mr. Kelley said he felt this section should be completely eliminated, since it is im the nature of a fine for non-compliance, and was completely improper for the City to impose. Mr. Ollendorff said that this was a fee for an inspection which was brought about by the owner's failure to comply with the code within the time given. He said the amount charged is for the rein- spection. Mr. Kelley moved to delete section (c)'under 3.6 Other Fees. Mr. Sabol seconded the motion. Upon roll call, the following vote was recorded: AYES: Councilmembers Kelley, Sabol and Thompson. N~S: Councilmembers Lieberman, Adams, Metcalfe and Mayor Mooney~ The motion was defeated by a vote of four to three. Mr. Ollendorff said Mr. Sabol had noticed that the permit applications do not spell out which fees are-refundable and which are not. In the future, that information will be shown on the permit application forms and on the permits. Mr. Adams moved that this bill be adopted as an ordinance. Mrs. Metcalfe seconded the motion. Upon roll call, the following vote was recorded: AYES: Councilmembers Sabol, Thompson, Lieberman, Adams, Metcalfe, Kelley and Mayor Mooney. NAYS: None. Bill No. 7431 became Ordinance No. 5239. BILLS FOR INTRODUCTION BILL NO. 7432 - AMENDING CHAPTER 4 MUNICIPAL CODE RELATING TO ALCOHOLIC BEVERAGES, BY REPEALING SECTION 4-6 THEREOF, AND ENACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN AS "SECTION 4-6. LICENSE - APPLICATION - FORM, FEE AND CONTENTS; PREREQUI- SITES TO ISSUANCE OF LICENSE; RENEWALS," AND PROVIDING THAT A PUBLIC HEARING BE HELD BEFORE A LIQUOR LICENSE SHALL BE ISSUED, AND!INCREASING THE FEE. A bill was introduced by Councilmember Sabol, entitled: "AN ORDINANCE AMENDING CHAPTER 4 OF THE MUNICIPAL CODE OF THE C-ITY OF UNIVERSITY CITY, RELATING TO ALCOHOLIC BEVERAGES BY REPEALING SECTION 4-6THEREOF, AS AMENDED BY ORDINANEE NO. 4731, ENACTED MAY 15, 1972, RELATING TO LIQUOR LICENSES, AND EN- ACTING IN LIEU THEREOF A NEW SECTION TO BE KNOWN-AS "SECTION 4-6. LICENSE - APPLI- CATION - FOPd~,' FEE AND CONTENTS; PREREQUISITES TO ISSUANCE OF LICENSE; RENEWALS,' AND PROVIDING THAT A PUBLIC HEARING SHALL BE HELD WITH NOTICE TO INTERESTED PARTIES BEFOREA LIQUOR LICENSE SHALL BE ISSUED TO SELL ANY KINDS OF INTOXICATING LIQUORS AND INCREASING THE 'FEEl'CONTAINING A SAVING CLAUSE AND PROVIDING A PENALTY."
