Session 1258, Minutes Page 6 <br />September 22, 19'80 <br /> <br />Mr. Sabol moved t~. defer action. The motion died for lack of a second. <br /> <br />Mrs. Metcalfe said if the Council is concerned about conditions not being met, it <br />has the discretion to withhold approval until the agreed-upon conditions are actu- <br />ally accomplished by the developer. <br /> <br />Mr. Kelley noted that Council has a final backup with the occupancy permit, since <br />they will not be issued if developmen[ standards are not met. He felt it did not <br />make sense to defer action. <br /> <br />Mrs. Metcalfe said she felt the situation may now be somewhat different than it was <br />when the condominium ordinance was passed, with respect to the current vacancy rate <br />and the desirability of having more condominiums available, but she also felt that <br />Council should approve this one, since it is in compliance with current laws gov- <br />erning condominiums. <br /> <br />Mr. Adams called the question. <br /> <br />Mr. Sabol moved to table. There was no second. <br /> <br />All voted Aye to approve the application except Councilmembers Sabol and Thompson, <br />who voted Nay. <br /> <br />CONDOMINIUM CONVERSION AT NOS. 1 AND 3 HEARTWOODS COURT <br /> <br />Th~ City Manager said an application was received to convert an eight-family apart- <br />ment at Nos. 1 and 3 Heartwoods Court to condominiums. The proprietor, Mr. Ken <br />Shapiro, has pledged to meet all inspection requirements. The application is in <br />compliance with all requirements of th~ City Code. <br /> <br />Mr. Sylvan H. Robinson, 8041 Cornell, representing Mr. Shapiro, 10935 Janridge, <br />asked to address the Council. Mr. Robinson said Kenstan Realty is the developer <br />Of this building, which is Just west of Canterbury Gardens. Mr. Robinson said the <br />company will make additional improvements over what is required in the code. Ten- <br />ants have.already been'given a 90-day notice, and all leases will be honored. It <br />was not possible to ha~e separate water meters, so the water rates will be prorated <br />among the eight apartments. Present tenants will be given first choice to buy <br />their apartment at a discount. <br /> <br />Mr. Sabol said he had received a letter from a present tenant who said there had <br />been a lot of problems in the building. Mr. Robinson said the building inspection <br />addressed itself to these problems, and they will be corrected. Mr. Sabol said <br />there were a number of other complaints, and Mr. Robinson said anything which did <br />not meet the code would be corrected. He said that Kenstan Realty had just pur- <br />chased the building for purposes of condominium conversion, and that the building's <br />problems were in existence prior to that. The conversion process should correct <br />the problems. Mr. Shapiro said the apartments would probably sell in the $40,000 <br />range, and that two of the tenants may buy their apartment. In answer to Mr. Sabol's <br />question about relocation, Mr. Shapiro said some research had been done, and it was <br />found that some units were available in Canterbury Gardens at a reduced rent, and <br />some on Delmar. Mr. Sabol moved that the application be denied. <br /> <br /> <br />
