Session 1806 <br />March 19, 2001 <br /> <br />has approved hundred's of conditional uses and we have been very diligent in asking <br />people if they are aware of the conditions and if they can comply to the conditions and <br />the answer has always been yes. The applicant has always been able to control and <br />comply with the conditions. In this case, the applicant can not control the last two <br />conditions. We can't expect them to comply to this, because they can't control this. <br />This is a losing proposition for both of us. He feels very strongly that this is not fair to <br />the applicant, for the City to oppose restrictions on them that is beyond their control. <br /> <br />Mr. Lieberman moved to amend the main motion to approve with conditions except <br />number 7 and number 8. Mr. Sharpe seconded the motion. <br /> <br />Mr. Sharpe agrees with Mr. Lieberman that the owner of this business is being placed in <br />the middle between the City and the property owner, Mr. Ghasedi. <br /> <br />Mr. Wagner is very much torn on this issue. On the one hand, he thinks the tenants <br />coming in will be very good tenants and he would really like to see that business go in <br />down there. On the other hand, he believes that the conditions we are asking for are <br />legal and reasonable. We have heard good, strong reasons why Mr. Ghasedi doesn't <br />want to open his lot. He feels very uncomfortable voting on this tonight. <br /> <br />Mr. Wagner stated that he wants Mr. Ollendorff and Mr. Ghasedi to try once again to <br />reach some type of compromise that is acceptable on conditions 7 and 8, and he wants <br />to hear the results when this is brought back at the next meeting. <br /> <br />Mr. Wagner moved to table this issue to permit the City Manager and the property <br />owner time to negotiate the last two conditions. Mr. Schoomer seconded the motion, <br />which carried unanimously. <br /> <br />CITIZEN COMMENTS: <br /> <br />Grant Shostak, 1060 Wilson, stated that he was asked by the U. City East Politics and <br />Action Committee, to invite the City Council and City Manager to their next meeting, <br />which is May 2nd at 6 p.m., which will be held at All Saints Church, 6403 Clemens. One <br />of the topics discussed will be unpaid refuse bills. <br /> <br />Mark Grimaldi, 7283 Northmoor, wished to lodge a complaint about a ticket he received <br />on his little Ford pickup, outside of his house. He stated that the ordinance states that <br />you can't park any pickup truck on any street or alley between the hours of 2am - 6am. <br />He wants the know the intent of the ordinance and when it was written and why it is still <br />on the books. A little Nissan truck is illegal too park, but a SUV is legal. Quite frankly, <br />he doesn't understand this. <br /> <br />11 <br /> <br /> <br />
