Session 1807 <br />April 2, 2001 <br /> <br />for this applicant's portion of the building, Future administrative enforcement efforts wil~ <br />be undertaken to convince other tenants to share their parking spaces with customers <br />as voluntarily permitted by the owner. <br /> <br />The motion that was tabled on April 2nd was moved by Mr. Lieberman, which stated <br />approval with all conditions except that he wanted to delete conditions 7 and 8. It was <br />seconded by Mr. Sharpe and then tabled. <br /> <br />Mr, Wagner would advise defeating this amendment. This was tabled pending further <br />discussion and negotiation between the property owner and the City Manager, This <br />discussion has taken place and he believes that there is a basis for a compromise <br />agreement. Therefore, he recommends defeat of Mr, Lieberman's amendment. <br /> <br />Much discussion commenced between Councilmembers and the Mayor as to the <br />proper way of dealing with Mr. Lieberman's motion to amend. <br /> <br />The motion to amend failed one to six, with Ms. Colquitt, Mr. Munkel, Mr, Wagner, Mr. <br />Schoomer, Mr. Sharpe and Mayor Adams voting NAY. <br /> <br />Mr, Wagner stated that the Plan Commission had recommended this conditional use <br />with eight conditions. Number seven had to do with parking and number eight had to <br />do with trash removal. This was tabled two weeks ago, so the City Manager could <br />discuss these last two items further with the property owner. He believes there is a <br />compromise agreement. <br /> <br />Mr, Wagner moved the following amendment to condition number 8: It should say that <br />the trash dumpster shall be moved in a manner consistent with the two plans discussed <br />by City staff and the property owner, Mr, Munkel seconded the motion, <br /> <br />Mr, Schoomer called a point of order, He stated that the motion which brought this to <br />the table was to approve this with conditions. He asked if this was just acting on <br />amendments now, The Mayor stated, yes, that they were currently just dealing with <br />amendments. <br /> <br />The motion to approve the amendment to condition eight carried unanimously. <br /> <br />Mr, Wagner moved an amendment to condition seven, to state at least two designated <br />parking spots would be reserved for Smoothie, the tenant, These parking spaces must <br />be provided during Smoothie's operating hours up to 9:00 p,m, Mr, Sharpe seconded <br />the motion, which carried unanimously, <br /> <br />7 <br /> <br /> <br />
