Session 1807
April 2~ 2001

Donald Murano, 7238 Pershing, stated that the operators of Smoothie King were
excellent businessmen and their foresight is definitely what this community needs. He
agrees with Council's action this evening.

Patrick Liberto, 7359 Dartmouth, wished to thank Mr. Ollendorff for his efforts in working
this out with Mr. GhasedL He wanted to make clear, for the record, that at the last
meeting, he was only representing his own business interests, not the entire LSBD, He
does, however, have a letter signed by twenty businesses, of which six are LSBD board
members, of support for the Smoothie King operation and stating that the conditions of
the conditional use permit should be directed at the proper parties. He is glad that the
Council approved the project and that a compromise on the last two conditions has
been reached.

Mr. Ollendofff asked Mr. Liberto if it was true that this issue was never discussed at a
LSBD board meeting and if it was true that several Loop board members were opposed
to the letter he mentioned and refused to sign it, Mr. Liberto responded that this never
had an opportunity to be discussed at a LSBD board meeting. The last City Council
meeting was after the last meeting and they obviously haven't had the April meeting
yet. He stated that there were some beard members that would not sign, because of
varying reasons. He does not have any desire to mislead anyone. He will file the letter
with the signatures with the City Clerk. (Clerk's note: this letter has not been filed as of the
transcribing of these minutes)

Mr, OIlendorff asked Mr. Liberto if he was willing to take up the owner's offer for him to
allow his customers to park in this lot. Mr. Uberto stated that, as far as his agreed
space that he has for himself, he would be more than happy to try and contribute to the
lessening of the effects of the neighborhood by one space. Mr. Ollendofff said that this
would really go a long way towards showing the good faith that Patdck brings to the
table that he is willing to abide by this agreement and he should be commended for
that.

David Trauterman, 1617 Dawnbreak, St. Charles, Smoothie King owner, thanked
OIlendorff for agreeing to meet with Mr. Ghasedi to come up with a satisfactory
agreement. They agree with all the conditions and the two amended conditions. He
wanted to make sure that this parking arrangement would not limit them to closing at 9
p.m. Mr. OIlendorff said that this will not limit his operating hours, it just means that Mr.
Ghasedi will be able to gate his parking lot at 9 p.m.

Mr. Wagner moved approval of the amended conditional use permit. Mr. Sharpe
seconded the motion, which carried unanimously.

8
