Session 1508, Minutes Page 5
December 11, 1989

moved that this item be removed from the table. F~. schoomer seconded the mo-
tion, which carried unanimously.

Mr. ~ms moved approval, with Mrs. sch~m~n, seconding the motion.

Mr. Schoc~er was concerned that gI-anting t/]e requested license would not limit
the operator to the sale of a few type~; of wine or the limited selling space
described. Mayor Majerus said Council ~may recall t/he only time it had lever-
age in such a case was when it approved, a site plan (to which conditions were
attached) for the business at the same time as the liquor license. There ~as
D/rt_her discussion, and Mr. Ollendorff said he would a~/ise the applicant, if
the license is denied, that several members of the Council inquired vJaether a
site plan would be submitted. In re~onse to F~. Price, Mayor Majerus said
Council could %~ive the site plan application fee. Mr. Schoomer said he in-
tended to vote against the motion, but would vote in the affirmative if accom-
panied by a voluntary request for site plan, with fee waiver.

All voted Nay on the motion to approve +_~he liquor license. The Mayor asked Mr.
Ollendorff to inform the owner of Council's reasons for denying this license.

LIQUOR LIC~I~SE -1148 ~'k~GtJSON

The City Manager said the new ~ner of the Stop and Shop Market at the corner
of Ferguson and Plymouth requests a lic~u%se to sell beer by the package at re-
tail. At the last meeting, Council ask¢.d that neighbors be notified this mat-
ter w-as to be on the agenda, and about 18 notices were s~%t. He said several
phone calls were reCeived from neighbors who would not give their names but
said they were opposed to beer being sold at this market.

Mr. Ben Str~wder, 6806 Plymouth, said he was very concerned about cleanliness
near the store, noting that when the store had a liquor license, people drank
beer au~oss the street and left their ¢~uns all over. He said if the license
is approved, he would like the owner to agree to keep the area cleaned up.
Mayor Majerus pointed out that could not be attached to the liquor license.

~e applicant, Fir. Amrick Shinger, said 75% of the people hn the neighborhood
asked him to try to get a license to sell packaged beer. Responding to Mrs.
Thompson, Fir. Shinger said if he receiw~ the requested license, he would make
certain the area around the store is cle~nned up every day.

Mr. Price said he thought the ~ questions (about cleanliness) were asked of
the previous owner, and he was concern~ that once the license was approved,
policing of the area might not be so vigorous. He also felt that the store's
having a license would not be of gen~_~al benefit to this neighborhood, even
though a few people might be inconvenienced. He suggested that the new
be allowed to operate for a time, and then if it seems he is monitoring the
litter situation, he could reapply for the licep~se. Mr. Shinger said the
store vras messy when he bought it, but he has made a lot of improvements. He
also said 90-95% of his customers ask ~%en he will get a beer lic~u~e.

Mr. Wagner asked the hours that beer would be sold, if a licer~e is obtained.
Mr. Shinger said 9:00 a.m. to 7:30 p.m. Monday through Saturday.
