Session 1816
July 16, 2001

More measuring is required for one of these errors. Mr. Ollendorff asked that the
Council not act on the resolution as presented on the agenda later this evening until
these errors can be corrected.

Mr. Ollendorff also said that all of the work that the City undertook to contract was in
precise conformity to the specifications thaLt the citizens signed for on their petition.
One issue came up during construction and that was a matter of adding exposed
aggregate to color the curbing. The residents had originally specified that there not be
any additional expense for that. During the course of construction, several residents
indicated that they wanted the aggregate to be exposed so that the curbing would have
a color similar to what currently exists. The subdivision trustees paid $2,000 for that
extra coloring. The City Council and the trustees request that that cost be reimbursed
to the subdivision and spread among the 2:1 properties. Mr. Ollendorff said that before
the Council can do this, a written invoice a~nd a signature of 2/3 of the property owners
is needed. One trustee requests that Council waives the signature requirement and
just accept his assurance that a large number of property owners did approve it
verbally. Council needs to decide whether we are going to require signatures or not
and then when we need the residents to raise any other comments or suggestions this
evening. He does ask that the resolution be tabled this evening until a proper response
can be given to everyone.

Mayor Adams said that there 'were no requests to speak.

Responding to Mr. Lieberman, Mr. Ollendorff said that the only University Heights #2
residents being assessed are the residents on the assessment roll on the 6900 block of
Washington. Only the ones receiving the benefit will be assessed which is the
residents on the 6900 block of Washington. Responding further to Mr. Lieberman, Mr.
Ollendorff said that an assessment roll was mailed to each of the owners on the 6900
Block of Washington. He had heard from Jerry Koczan, a trustee, who had a question
about his own assessment and had stated that he hoped that the Council did not
require more signatures for the $2,000 expenditure.

Mr. Wagner believes that signatures should be required, thereby avoiding problems in
the future. He does not believe it is too onerous for the trustees to go out and gather
2/3 of the signatures.

Responding to Mr. Sharpe, Mr. Ollendorff ...;aid that he does recall Mr. Koczan giving
him a reason for not wanting to go out and get signatures. Mr. Koczan made it clear to
him that he did not feel it was necessary to get signatures, that he, as trustee, could
represent the neighborhood.

3
