Session 1836 April 8, 2002 a liquor license. Mr. Sharpe stated that the store does not belong to the parties on Hanley. He would advise Council that a liquor license not be denied based on what is going on at the Vernon site. Mayor Adams wanted to clarify that Council was approving a site plan tonight - not a liquor license. Mr. Sharpe is aware of this, but wished to clarify Mr. Ollendorff's belief that these two stores were connected. They are owned by different owners. Ms. Colquitt also understands that we are not voting on a liquor license, but the store on Vernon needs to look much better than it does even though it is owned by another owner. The Hanley store is looking much better. Mr. Lieberman reminded the Council that the problem with differentiating between these two is difficult because they are both called Pete's Shur Save. If the Vernon location were to change its name, maybe we could deal with it in a different manner. Mr. Ollendorff noted that it was his expectation that the liquor license would probably be on the agenda for the next meeting. The police staff is updating the information that the applicant submitted approximately a year ago. Once that is done, it will be presented to the Council. Responding to Mr. Schoomer, Mr. Ollendorff said that the Council denied the previous application for a liquor license without prejudice, so they would not have to repay the application fee or investigation. The motion to approve carried unanimously. AGENDA ITEM #3 - CONDITIONAL USE - 7531 OIVE AS GASOLINE STATION/CONVENIENCE STORE: Mr. Ollendorff concurs with the Plan Commission recommendation that the conditional use permit be approved subject to conditions that construction and development comply with designated revised site plans, installation of an approved landscape plan prior to occupancy, hours of operation 6:00 a.m. - 10:00 p.m. with no overnight outdoor parking, repair of paving and striping, no outdoor sales or pay phones or merchandise displays. Mr. Lieberman suggested three additional conditions that he and staff agrees with: that there be no ATM outside; that there be no food sales outside and that there be compressed air available outside. Mr. Ollendorff suggested that the applicant be asked if they agree with these three additional conditions. Dan Ryan 180 Park, St. Peters, Missouri is the area representative for Sinclair. He stated that they have no problems with any of those conditions.
