Session 1839 <br />May 6, 2002 <br /> <br />with this item. Number one is the walkway. In the old site plan, we asked them to put a <br />walkway on private property. Mr. Munkel doesn't see how we could possibly mandate <br />this request on someone else's private property. Mr. Sharpe said that this was a no- <br />brainer and should be eliminated as a condition. The Council agreed. <br /> <br />Mayor Adams asked the sense of Council on the old site plan request to furnish <br />benches. The sense of Council was to remove this condition. Mayor Adams asked Mr. <br />Ollendorff to research the originations of this request. He can't figure out why this would <br />ever have been included. The Council agreed. <br /> <br />Mayor Adams asked the sense of Council on the video game issue. Mr. Munkel said <br />that these should be allowed in accordance with existing law, either County or City, <br />whatever is the more restrictive, unless we change the law. The Mayor wants to add a <br />provision that the video games be placed in the building in a way where they can not be <br />seen from the outside. The Council agreed. <br /> <br />Mayor Adams asked the sense of Council on the hours of operation. The Mayor <br />believes that the operation slhould operate according to the current ordinance. If the <br />Council wants to make a change to the ordinance, then a member of the Council needs <br />to request the City Manager to draw up a bill to amend the ordinance to allow the <br />Council to make exceptions :to the stated operating hour requirements under very <br />stringent conditions, such as they must always have a physical attendant and they must <br />always have electronic monitoring systems. The physical attendant should be able to <br />have the authority to call police to get rid of loiterers and whatever. Ms. Welsch asked <br />for clarification as to the options the Council had in amending the ordinance. Mr. <br />Ollendorff restated that the Council could do two things, either change the hours of all <br />Laundromats or to leave the hours as is, but giving the City Council the authority to <br />make exceptions with conditiions. Responding further to Ms. Welsch, Mr. Ollendorff <br />stated that the ordinance that we currently have on the books does not allow the <br />Council to make an exception. Responding to Mr. Sharpe, Mr. Ollendorff stated that a <br />trial operation period could be instituted to try this twenty four hour concept out in this <br />new area. Mr. OIlendorff stated that this was also a condition on the 1992 site plan. It <br />stated that if the City Councill determined that there was loitering on the parking lot late <br />night or early morning then the hours would be restricted back to closing at midnight <br />and opening at 7 a.m.. Council could attach a trial period as one of the conditions. <br /> <br />Mr. Munkel asked for the City Manager to draw up a bill amending our current ordinance <br />to add conditions listed in #1281, dated September 23, 1992, to give Council authority <br />to make exceptions as needed. <br /> <br />Ms. Welsch asked the applicants if they would even be willing to build the building if <br />they could not be guaranteed a twenty four hour operation. Mr. Williams said that 30% <br />of the owner's revenue comes in during this period of time. This money is needed to <br />complete the building. We need the twenty four hours.
