Session 1839 <br />May 6, 2002 <br /> <br />business and buffering landscaping that separates the residential area. The <br />Laundromat will be located closest to Kingsland. <br /> <br />Responding to Mr. Munkel, Mr. Williams responded that the building is not going to be <br />all a laundromat. The Laundromat is only going to be a portion of the building. <br /> <br />Mr. Wagner said that the trial period from 1992 was not to be construed as a threat, but <br />as an incentive to properly police the area and keep the loitering down. Mr. Williams <br />said that they will comply with the terms of the 1992 agreement. <br /> <br />The Mayor entertained a motion with conditions, excluding the walkway, the benches, <br />which will require they follow the most restrictive ordinance on screened video games, <br />which will require them to follow the hours of operation in the current ordinance - noting <br />that an amended ordinance has been requested. <br /> <br />Mr. Williams asked for clarification on the hours of operation. Mayor Adams said that <br />they have to follow the current ordinance; however, the Council has requested an <br />amendment to that ordinance that will allow the Council the authority to make <br />exceptions to extend the hours of operation. The applicant will be able to come back <br />before Council, without prejudice, and ask for an exception to the hours of operation. <br />Mr. Williams said that they can't afford to build the building without the twenty four hour <br />operation. Mayor Adams said that Council can not permit this to happen, because they <br />do not have the legal authority to allow it. He apologized for the inconvenience, but this <br />process must be dealt with in this manner. <br /> <br />Responding to Ms. Welsch, Mr. Ollendorff responded that it would probably take about <br />three meetings to go through this process. He also added that the applicant has been <br />very aware of the need to go through this process for many months. This is nothing <br />new to them. <br /> <br />Mr. Lieberman moved approval. Mr. Munkel seconded the motion. <br /> <br />Ms. Welsch asked for further clarification on the motion. The Mayor said that the <br />Council is approving the site plan with those conditions that the Council agreed with and <br />lined out the conditions that the Council did not agree with. We also added that we <br />would follow the current ordinance as it provides. <br /> <br />The motion to approve carried unanimously. <br /> <br />AGENDA ITEM #7 - COMPREHENSIVE PLAN AMENDMENT - NORTHEAST <br />NEIGHBORHOOD PLAN: <br /> <br />Mr. Ollendorff concurs with the Plan Commission and Planning staff decision to amend <br />the 1999 Comprehensive Plan by adding the newly completed Northeast Neighborhood <br /> <br /> <br />
