Session 1839 <br />May 6, 2002 <br /> <br />AGENDA #6 - 877 KINGSLAND, RETAIL/SERVICE BUILDING: <br /> <br />The City Council recently approved a conditional use permit for the construction of a <br />commercial development at the southwest corner of Kingsland and Vernon. The plan <br />has been revised to build a somewhat smaller building covering less than 70% of the <br />site. This size development requires site plan approval rather than a conditional use <br />permit. The project has been reviewed and may be approved provided the plan is <br />modified and clarified. Several changes were agreed upon by all parties including <br />conformance with sign code, trash containers and litter policing; review and execution of <br />a detailed approved landsc, ape plan including specified trees and other plantings, <br />installation of a sight-proof fence or wall on the west and southwest sides; approval of <br />curb cuts, drainage, grating, and irrigation by appropriate authorities; loading areas and <br />lighting in compliance with City codes; building size conforming to these plans; limited <br />hours for trash removal and limited noise from mechanical equipment. Several other <br />conditions were deemed important by the City Council, which are questioned by the <br />applicant and will require further discussion including improvements to a private <br />walkway from University Heights to Vernon, installation of benches near Vernon and <br />Kingsland, prohibiting electronic or video games, hours of operation limits of 8:00 a.m. <br />to 11:00 p.m. The applicant plans to address these last issues with the City Council <br />since they perceive some modification of these restrictions to be necessary for this <br />development to be successful. The conditions regarding video games, hours of <br />operation and mechanical unit noise were added by the City Council to all of the other <br />suggestions, which came from City staff. City ordinances require all laundromats to <br />close between midnight and 7:00 a.m. and no video games can be in operation during <br />late night hours plus numerous other restrictions and limitations if the location has more <br />than three devices. Mechanical equipment noise is regulated by several City and <br />County ordinances. <br /> <br />Mr. Ollendorff recommends approval of the site plan as soon as modifications and <br />adjustments are accepted by the applicant in order to be in full compliance with all City <br />ordinance requirements and standards, which aim among other things at protecting <br />nearby residential environments while promoting high-quality commercial development. <br /> <br />Mr. Munkel moved approval. Mr. Wagner seconded the motion. <br /> <br />Kevin Williams, 432 Edgewood Dr., is the attorney for the developer. He explained the <br />development to the audience. He introduced Mickey Jones, the operator of the <br />Laundromat at 6625 Delmar. They wish to close down the Delmar store and open up a <br />new store at this site. They do not want park benches because they feel that it will <br />promote loitering. They want to operate twenty four hours and they would like the <br />conditions at 6625 Delmar, where they can operate twenty-four hours currently, to this <br />location. <br /> <br />7 <br /> <br /> <br />
