Session 1839 <br />May 6, 2002 <br /> <br />Mr. Wagner asked for some clarifications from Mr. Williams. Mr. Williams explained that <br />they currently have a twenty-four operation on Delmar. They simply want to close the <br />store on Delmar, and transfer the twenty four operation to the new Kingsland store. Mr. <br />Wagner asked for Mr. Ollendorff to explain why we have a Laundromat that is open <br />twenty-four hours when his information tells him that we have an ordinance on the <br />books that requires all Laundromats to close between midnight and 7:00 a.m. Mr. <br />Ollendorff explained that in 1992, the applicant came before the Council and convinced <br />them to approve a twenty four hour operation, even thought that was beyond what the <br />ordinance allowed. The Council adopted the exception with some conditions by an <br />unanimous vote. <br /> <br />Mr. Ollendorff said that if the Council does determine hours beyond the restrictions in <br />the ordinance are in order, then it would be appropriate and preferable that the Council <br />amend the ordinance, rather than make another exception which would be <br />questionable. <br /> <br />Responding to Mr. Sharpe, Mr. Ollendorff said that the exception was granted by the <br />Council in September of 1992. The Planning Director recommended approval of <br />expanding the operation to twenty four hours at this address with a number of <br />conditions. The Council moved the motion, seconded it and it passed unanimously. Mr. <br />Sharpe asked since the Laundromat has been operating for twenty four hours, what has <br />been the results as far as any particular problems. Mr. Ollendorff said that there have <br />been occasional complaints. He is not sure if the complaints are due to the twenty four <br />hour operation or just to the presence of a laudromat. Most complaints deal with <br />general nuisance type of complaints: noise, loitering, litter, people coming in to just play <br />the games rather than doing laundry. It is not everyday that people call in complaining, <br />but on occasion only. <br /> <br />Responding to Ms. Welsch, Mr. Ollendorff replied that if we amended the ordinance <br />then it would apply to all Laundromats in the city. He also pointed out that we could <br />amend the ordinance to give the Council the authority to make an exception. At this <br />point, what the Council did in 1992 was really beyond the authority of the Council. <br /> <br />Mr. Munkel pointed out that this proposal is on a piece of property that has been vacant <br />for well over a decade. He believes we have a very good building design proposed and <br />the things we are talking about are issues added to the previous site plan, such as the <br />video games and hours. The condition requiring the developer to fix up the sidewalk in <br />a private subdivision is hard for him to understand. We can't mandate this developer to <br />fix up a sidewalk on some other owner's private property. He would like this <br />development to be built and he would like to see the Council come to an agreement on <br />this, maybe with a few changes. He would like to look at amending the law on <br />Laundromats. <br /> <br />Mr. Wagner is not in favor of changing the hours in the ordinance, but would be in favor <br /> <br /> <br />
