August 29, 2007

Ms. Joyce Pumm, City Clerk Re: Application for Conditional
City of University City Use Permit P007019
6801 Delmar Boulevard 7245 Olive
University City, MO 63130

Dear Ms. Pumm:

At its regular meeting on August 22, 2007 at 6:30 p.m. in the Emergency Operations Center
of City Hall, 6801 Delmar Boulevard, the City Plan Commission conducted a public hearing on an
application by BWP Inc. (dba Traffic Jams) for a Conditional Use Permit to allow the premises at
7245 Olive to be used as a car audio installation facility (vehicle service center).

The Plan Commission determined that the evidence presented supports the conclusion that
the proposed conditional use: a) Complies with all applicable provisions of chapter 34 of the
University City Zoning Code; b) At the specific location will contribute to and promote the
community welfare or convenience; c) Will not cause substantial injury to the value of neighboring
property; d) Complies with the overall neighborhood development plan and existing zoning district
provisions; and e) Will provide, if applicable, off-street parking and loading areas in accordance with
the standards contained in the University City Zoning Code. A motion was made by Ms. Borg,
seconded by Mr. Myers and passed by a vote of 7 to 0 that the Plan Commission recommend
approval of the application for a Conditional Use Permit subject to the following conditions:

1. The operator shall regularly police the site and the area adjacent to the restaurant to remove litter
and debris.

2. Trash containers for patron use shall be available on the premises at all times. Adequate refuse
disposal shall be provided by and for the business. The refuse containers and surroundings shall be
maintained in a clean condition.
3. The hours of operation shall be limited to those between the hours of 8:00 a.m. and 7:00 p.m.
4. The facility shall be operated so that noise complies with the University City Noise Ordinance
(Section 9.08.240).

Sincerely,

Steve Myers, Chairperson
City Plan Commission
cc: Julie Feier, City Manager
I-2-d
September 4, 2007
