"Scavenging" means the physical examination of refuse in a refuse container for the removal <br />of items from a refuse container by persons other than the city and persons authorized under this <br />chapter to use the refuse container. <br /> “Solid Waste”is defined as garbage, refuse, durable goods (e.g., appliances, tires, batteries), <br />nondurable goods (e.g., newspapers, books, magazines), containers and packaging, food wastes, <br />yard trimmings, and miscellaneous organic wastes from residential, commercial, and industrial <br />sources and any other discarded materials, including solid, semisolid, or liquid resulting from <br />residential, commercial and community activities. <br /> “Yard waste” means organic material consisting of tree trimmings and brush, leaves, grass <br />clippings, and other forms of organic garden waste. <br />8.12.020 Scope of chapter; director of public works to enforce. <br /> A. The city shall be the exclusive collector of residential solid waste and shall collect such <br />solid waste at least once each week. The city may collect non-residential solid waste as <br />determined by the director of public works. Prohibited refuse shall not be collected by the city <br />unless authorized by this chapter or the director of public works. In collecting refuse the city may <br />use city personnel and equipment or may contract for such collection. <br /> B. The director of public works shall enforce this chapter to the extent provided herein and <br />shall have the authority and responsibility to (1) establish and revise regulations concerning the <br />storage, collection, conveyance, and disposal of all solid waste accumulated within the city, <br />including the frequency of collection and the type and location of solid waste containers, and (2) <br />grant exceptions to such regulations, and the requirements of this chapter, when strict compliance <br />is not necessary to promote the intent of this chapter and when such exceptions alleviate <br />unnecessary hardship or practical difficulty. <br /> C. The director of public works shall establish collection routes and schedules for residential <br />and non–residential solid waste. The director of public works shall promulgate regulations <br />regarding solid waste management. <br />8.12.030 Ordinance violations; public nuisance. <br /> A. It is unlawful for any person to store, collect, convey, or dispose of solid waste except as <br />provided by or permitted in this chapter, or to use any land, premises or property within the city <br />for the dumping or disposal of any solid waste, except at a city-authorized facility. <br /> B. No person shall, with the intent of avoiding the requirements of this chapter, deposit solid <br />waste into any solid waste container other than a container issued to, or for the benefit of, said <br />person or the property at which said person resides. <br /> C. No person shall cast, place, sweep, or deposit anywhere within the city any solid waste <br />into any water or watercourse or in such a manner that it may be carried or deposited by the <br /> <br />
