Session 1867
January 27, 2003

Ms Welsch was approved of the shared parking arrangement but wanted
reassurance that the building could hold up to 49 people safely. The City
Manager told her that, the while the Building Code limited occupancy to 49
because of parking, the Fire Department would also review the final building
plans for ingress and egress and may set another limit.

Mr. Sharpe wanted to know if the proprietors had agreed to all the contingencies
that were called for. Frank said that to his knowledge there were in concurrence.
The proprietor was asked to come forward.

Pastor Carol Mitchell, owner of the King's Day care center said that she had met
with Frank Hill, the Zoning Administrator, and complied with all the requirements.
The owner of the adjacent property agreed in writing to the parking arrangement.
Pastor Mitchell also said that the facility is becomes too small; they would search
for another site.
Mr. Munkel wanted to know if the building would cease to be a daycare center.
Pastor Mitchell answered that it is no longer a daycare center and is vacant.

Mr. Lieberman asked if she understood his concern about removing another
property from the tax rolls. She said that she did but was also under the
impression that there were other organizations in the city that take a much larger
share.

Mr. Sharpe asked if she understood the contingencies imposed by the City
Manager to maintain permit. She answered that she did.

Ms. Colquitt moved approval and Ms. Welsch seconded, and the motion to
approve was carried unanimously.

AGENDA ITEM # 4 - Liquor License - 6665 Olive

Mr. Ollendorff informed Council that the Addis Restaurant at 6269 Delmar in the
University City Loop had planned to relocate to larger quarters on the northeast
corner of Olive and Kingsland. This expansion was contingent upon the approval
of a liquor license by Council for this new location. He advised that all petition
and reference signatures were under review to verify that the applicant met all
the requirements of the City's ordinances. Addis recently passed their record
check as reported to the City Council in December in conjunction with their
Delmar liquor license. He stated that, since the new location never had a liquor
license, the Council could determine if it was necessary to set and hold a public
hearing on this application prior to voting on the matter.

Mr. Lieberman wanted to know if the building would be an adequate distance
from the new Children's Center. The City Manager answered that the required
distance is 150 Feet and that the restaurant would be located farther than that.
