Session 1869 <br />February 24, 2003 <br /> <br />Ms. Welsch declared that the restaurant was an established business, had been <br />a good tenant on Olive and that the move would be an asset. She wanted to <br />approve the upgrade. <br /> <br />Mr. Wagner asked Mr. Cranke if anyone had conferred with Mr. Ollendorff, the <br />City Manager and was informed that the client had been in touch with the City <br />Manager but she did not know the outcome. <br /> <br />Ms. Colquitt concurred with Ms. Welsch's statement and favored the upgrade. <br /> <br />Mr. Munkel stated that he did not believe that imposing a waiting period was <br />appropriate for an existing business. <br /> <br />Mr. Wagner agreed with Councilmembers' comments but wanted to know the <br />rationale behind Mr. Ollendorff's decision. He suggested tabling the matter until <br />the next meeting to confer with the City Manager. <br /> <br />Mr. Sharpe also wanted to speak with Mr. Ollendorff about a six-month waiting <br />period and suggested raising the issue at the next Council meeting. <br /> <br />Mr. Lieberman said that he believed that Mr. Ollendorff may have been following <br />previous rules established by Council concerning a full liquor license. The <br />purpose of a waiting period was to determine if a business was actually a <br />restaurant or a liquor store. However, he did not believe that this criteria applied <br />to this instance. <br /> <br />Ms. Colquitt opposed a one-month delay in the decision. <br /> <br />Mr. Wagner moved to approve transferring the existing wine and beer license to <br />the new location and consider the upgrade at another time. Mr. Sharpe <br />seconded this motion. <br /> <br />Mayor Adams clarified that delaying the granting of the full liquor license would <br />not require the payment of additional fees. <br /> <br />Ms. Welsch asked the Assistant City Manager, Mr. Thomas Moton, for his input. <br />He answered that the increased size at the new location was at the crux of the <br />decision; customarily a transition period for evaluation occurs before providing an <br />upgrade. <br /> <br />After a vote, the motion failed 2 to 5, with Ms. Colquitt, Mr. Munkel, Mr. <br />Lieberman, Ms. Welsch and Mayor Adams voting Nay. <br /> <br />Ms. Colquitt moved to approve transferring the existing beer and wine license <br />with a full upgrade at the new location. Mr. Wagner seconded the motion. <br /> <br /> <br />
