BILL 8651 - RELATING TO THE CONSTRUCTION, ESTABLISHMENT, <br />OPERATION AND MAINTENANCE OF THE CROSS COUNTY <br />METROLINK SEGMENT I EXTENSION BY THE BI-STATE <br />DEVELOPMENT AGENCY OF THE MISSOURI-ILLINOIS <br />METROPOLITAN DISTRICT ("BI-STATE"), AND PROVIDING FOR (1) <br />THE GRANT AND CONVEYANCE OF PERMANENT EASEMENTS TO <br />BI-STATE UNDER, OVER AND ACROSS PORTIONS OF PERSHING AVENUE, <br />WESTMORELAND DRIVE, PRATT AVENUE, FORSYTH BOULEVARD, AN <br />ALLEYWAY IN THE VICINITY OF BIG BEND BOULEVARD, AN ALLEYWAY <br />ADJACENT TO THE FOREST PARK PARKWAY, ANY PORTIONS OF FOREST PARK <br />PARKWAY BETWEEN THE EAST LINE OF THE CITY LIMITS OF THE CITY OF <br />UNIVERSITY CITY AND THE WEST LINE OF THE CITY LIMITS OF THE CITY OF <br />UNIVERSITY CITY IN WHICH THE CITY OF UNIVERSITY CITY MAY <br />HOLD AN OWNERSHIP INTEREST, (2) THE GRANT AND CONVEYANCE OF <br />TEMPORARY CONSTRUCTION EASEMENTS TO BI-STATE UNDER, OVER OR <br />ACROSS PORTIONS OF THE ACKERT WALKWAY AND A PEDESTRAIN <br />UNDERPASS EXISTING UNDER PERSHING AVENUE AND THE FOREST PARK <br />PARKWAY, AND (3) THE GRANT AND CONVEYANCE OF A PERMANENT <br />EASEMENT OVER A PORTION OF THE ACKERT WALKWAY PROPERTY. <br /> <br />The bill was given its second reading. <br /> <br />Mr. Ollendorff stated that University City was in the midst of a very exciting <br />project, which is to bring another segment of MetroLink into existence through <br />the City. This ordinance giving easements to Bi-State has been worked on for <br />approximately two years now. Bi-State has been extremely cooperative and <br />helpful working with the City staff, Councilmembers and citizen requests. The <br />only last issue is how traffic will be treated during the construction, specifically <br />on Forsyth and Delmar. Mr. Ollendorff said that he has received assurances that <br />this concern will be dealt with. <br /> <br />Mr. Ollendorff continued saying that the ordinance needs two amendments. On <br />page 2, paragraph a, the word "only" will be inserted in the second to last line <br />between "feet" and "as". This protects the paper alley located here to clearly <br />limit that easement to the area defined. On page 5, Section IV, Mr. Ollendorff <br />said that this section deals with the authority of University City to review the <br />reconstruction of the easement areas. He requests adding another line to this <br />paragraph that reinforces this authority and gives the City right of review and <br />approval from everything from reconstruction to the finishes of the stations. The <br />City cannot unreasonably withhold approvals, but this does strengthen the City's <br />position to make sure that our property is treated properly. Since these <br />amendments our substantial, it would be legally appropriate to hold off approval <br />for another seven days per Charter requirements or until the next meeting. <br /> <br />Mr. Ollendorff also said that the only remaining issue that is being discussed is <br /> <br /> <br />
