Session 1889 <br />June 23, 2003 <br /> <br />AGENDA ITEM # 5 Conditional Use 7640 Delmar Blvd. Automotive Service: <br /> <br />Frank Ollendorff agreed with the Plan Commission that this proposal met all <br />requirements of the city ordinance and would not injure the neighborhood provided <br />there was compliance with all conditions listed by the Commission. He recommended <br />approval of the conditional use permit subject to conditions that included site plan <br />conformance, appropriate landscaping, outdoor parking limitations, restricted hours of <br />operation, litter and trash removal requirements, compliance with city codes regarding <br />lighting and mechanical equipment, 8' screening structure at east property line, <br />drainage and traffic plans approved by appropriate agencies and driveways moved <br />south and east of intersection. The Council's approval would authorize construction of a <br />new building providing vehicle maintenance services related to motor oil changes. <br /> <br />Mr. Wagner made the motion and Mr. Munkel seconded it. <br /> <br />Mr. Lieberman asked if any gasoline service would be involved. The City Manager <br />replied that it would not and that an amendment would be required for any other usage. <br />Mr. Lieberman then asked if the developer would be required to remove the existing <br />underground tanks. <br /> <br />Mr. Ollendorff said that if removal of the those tanks was required if it had not already <br />occurred. Mr. Lieberman clarified that the over-night vehicles used for the business <br />must be parked on the premises. <br /> <br />Mr. Wagner said that he would be surprised if the tanks were gone, because they were <br />pumping gas there a very short time ago. <br /> <br />Mr. Munkel wanted to know the effect that a ban on on-street parking would have upon <br />existing businesses. Mayor Adams said that when we are dealing with auto repair <br />businesses we want to make sure that there is not overnight storage of vehicles to be <br />repaired. This type of operation is not that type of repair facility, though. <br /> <br />Mayor Adams asked if the site had been tested by the Department of Natural <br />Resources to avoid contamination of a housing developments in that area. Mr. <br />Ollendorff suggested that the Council add two additional conditions to its approval, i.e. <br />removal of underground gas storage tanks and the ground be D.N.R. certified by the <br />state. <br /> <br />Ms. Welsch would be interested is seeing the wording of the Department of Natural <br />Resources clearance, because she understands that they have never cleared a site <br />now and forever.
