Session 1894 <br />August 18, 2003 <br /> SECTION TO BE KNOWN AS "SECTION 9.08.180 SEXUAL MISCONDUCT," <br /> THEREBY AMENDING SAID SECTION SO AS TO DELETE THE TERMS <br /> "DEVIATE SEXUAL INTERCOURSE" AND "SEXUAL INTERCOURSE" BUT <br /> CONTINUE TO INCLUDE SUCH CONDUCT IN THE DEFINITION OF "SEXUAL <br /> CONDUCT"; CONTAINING A SAVINGS CLAUSE AND PROVIDING A <br /> PENALTY. <br /> <br />The bill was given its first reading and was assigned number 8671. <br /> <br />Mr. Munkel asked why this change is being introduced at this juncture when it <br />paralleled so closely to the State Statute and if there was a change of which he <br />was not aware. Mr. Ollendorff called for the City Attorney to draft this following <br />the Supreme Court decision recently to strike down definitions of sexual behavior <br />in state laws. Since this ordinance copied the language of the State Law, he <br />asked the City Attorney to prepare a bill which deleted from the City Ordinance <br />the language struck down by the Supreme Court in June 2003. <br /> <br />6. A bill was introduced by Mr. Wagner, entitled: <br /> <br />AN ORDINANCE AMENDING CHAPTER 2.66 OF THE MUNICIPAL CODE, <br />RELATING TO PLANNING AND DEVELOPMENT FEES, BY REPEALING <br />SECTION 2.66.040 THEREOF, RELATING TO APPLICATION FEES, SECTION <br />2.66.050 THEREOF, RELATING TO BUILDING PERMIT FEES, SECTION <br />2.66.060 THEREOF, RELATING TO MECHANICAL PERMIT FEES, SECTION <br />2.66.070 THEREOF, RELATING TO PLUMBING PERMIT FEES, SECTION <br />2.66.080 THEREOF, RELATING TO ELECTRICAL PERMIT FEES, SECTION <br />2.66.090 THEREOF RELATING TO INSPECTION FEES, AND SECTION <br />2.66.100 THEREOF, RELATING TO OTHER FEES, AND ACTING IN LIEU <br />THEREOF NEW SECTIONS WITH THE SAME SECTION NUMBERS AND <br />TITLES, THEREBY AMENDING SAID SECTIONS TO INCREASE NUMEROUS <br />PLANNING AND DEVELOPMENT FEES TO COVER THE COST OF <br />PROVIDING THE SERVICES; CONTAINING A SAVINGS CLAUSE AND <br />PROVIDING A PENALTY. <br /> <br />The bill was given its first reading and was assigned number 8672. <br /> <br />QUESTIONS REGARDING POOL CURBING: <br /> <br />Mr. Lieberman asked Mr. Ollendorff if the architects working on the new pool <br />modifications and updates had addressed the curb issue. Mr. Ollendorff <br />reported passing the question to the engineer and he responded they would <br />restore the elevation at the edge of the pool to its current level.
