Session 1896
September 4, 2003

Mr. Wagner asked it there would be a cost estimate by then and he was assured
there would be. Delay is due to people being on vacation.

Mr. Ollendorff reported that three of the four advocacy groups recommended to
provide review of the plans have been contacted, and the one responding
verbally had some concerns about the curb, but thought it could work. Mayor
Adams asked for responses from these groups in writing.

Mr. Wagner asked for clarification of an L-shape object in the diagram, and was
advised that it is an anchoring system, for reinforcing. Then he reviewed with the
Council a schedule of action to be taken by them:
1. decide about the curb on September 15, 2003
2. have engineers redesign the pool
3. start the renovation of the pool
4. open the new pool late May in 2004

Ms. Welsch asked if EDM will no longer undertake the design, and Mr. Ollendorff
said that may eventuate if EDM finds that it could make them liable. Some
discussion ensured as to whether the curb actually constitutes a potential liability.
Mr. Ollendorff advised that the best possible information will be provided for the
September 15, 2003 meeting so that the Council can make an informed decision
then.

Mayor Adams asked for a motion to approve the contract for the pool. Mr.
Wagner moved approval of Westport Pool. Ms. Welsch seconded the motion,
which carried unanimously.

Mr. Munkel asked if changes could be made to the contract to accommodate
whatever decision is made about the curb, and Mr. Ollendorff said any change
whatsoever requires a change order because a change is not part of the original
specifications, and it is likely that there will be some before the project is
completed. If changes amount to over $10,000, permission must be obtained by
Mr. Ollendorff from the Council.

Ms. Welsch expressed pleasure at the amount of the estimate for the pool, and
was advised that Westport had provided the estimates to the engineers, and
were known to them as leading pool builders who asked reasonable prices.

CITY CLERKS' DOCKET:

BILLS FOR INTRODUCTION:

A bill was introduced by Ms Welsch, entitled:

Page 5
