Session 1904 <br />December 15, 2003 <br /> <br />Letters Commission to review the sculpture, because its sudden appearance will startle <br />citizens and members of the Commission. Mr. Lieberman pointed out that the Council <br />has no say over the sculpture to be placed in front of Craft Alliance. Mr. Sharpe asked if <br />the Council could deny approval for the placement of the sculpture. Mayor Adams said <br />that the sculpture has already been purchased for use on private property, ensuring the <br />owner of certain rights, and the only reason for discussion about that placement is the <br />prior agreement cited by Mr. Ollendorff. Mayor Adams did not know the ramifications of <br />denying approval. Mr. Munkel then called for the question. There was a unanimous <br />vote to call on the question. The original motion to approve was passed by a vote of <br />AYES: five and NAYS: two (Ms. Welsch and Mr. Wagner). <br /> <br />Mayor Adams then asked Mr. Ollendorff to forward information to the Arts and Letters <br />Commission so they will be apprised of the change, making sure they understand it will <br />be placed on private property. <br /> <br />AGENDA ITEM 2 - 8130 DELMAR PLANT NURSERY/GIFT STORE - CONDITIONAL <br /> <br />USE PERMIT: <br /> <br />Mr. Ollendorff concurs with the Plan Commission recommendation for approval of a <br />conditional use permit to allow this corner lot to be utilized as a plant nursery/gift retail <br />establishment with outdoor plant material display. Conditions should include timely <br />installation of an approved landscape plan. Outdoor uses limited to gardening and <br />planting materials appropriately displayed, repaving asphalt surfaces, regular litter <br />policing of the site and adjacent public property, litter and refuse disposal containers <br />properly sited and maintained, lighting in compliance with codes and protective of <br />neighboring properties and construction of a six foot high sight proof fence or wall <br />adjacent to residential abutting properly. <br /> <br />Mr. Munkel moved approval of this measure and Mr. Sharpe seconded the motion. <br /> <br />Discussion followed in which the following points were introduced: Ms. Welsch asked if <br />there was an estimate about the amount of traffic this business would generate? Mr. <br />Ollendorff reported that no study was made, but there was a staff finding, which <br />read:" ... it is reported that 17,000 cars per day and the manner in which the building is <br />situated will offer excellent visibility; there will be no extraordinary activity on the <br />property causing neighboring home owners to be annoyed with daily operation; hours of <br />operation are nine a.m. until six p.m., six days a week." Mr. Ollendorff said those <br />comments were the information provided by the applicant; the staff report to the Plan <br />Commission found the application to meet requirements, but contained no separate <br />analysis. Ms. Welsch encouraged the Council to take note of any unforeseen traffic <br />problems as the business becomes established. Mr. Sharpe said neighborhood citizens <br />attended the Plan Commission meeting when this new business was discussed and <br />expressed their pleasure at its opening at this site.
