Session 1904 <br />December 15, 2003 <br /> <br />Commission findings indicate the plans provides off-street parking and loading in <br />accordance with standards in the Ordinance, Mr. Ollendorff said. A review of the plans <br />revealed eight parking spaces, altogether. Mr. Munkel said that plans for this property <br />have come before the Council three times previously, and now it is time to approve the <br />application. Mr. Wagner called for the question. Mayor Adams called for the vote to <br />approve the plan and it was passed unanimously. <br /> <br />AGENDA ITEM #3 - Liquor License - 8631 Olive Blvd. <br /> <br />The owners of a new restaurant in Jeffrey Plaza request a license to sell all types of <br />intoxicating liquor by the drink including Sunday sales. The applicant appears to have <br />an acceptable background for this type of business. City Council's past policy has been <br />to require a six month observation period for a new restaurant before allowing alcoholic <br />beverage sales. Earlier approval has been granted if the applicant has a substantial <br />restaurant/liquor operation experience. In this instance the applicants have experience <br />in the food service and bartending industry but not as owners or business operators. <br />City Council also has the option of scheduling a public hearing before making a decision <br />on this application. My recommendation would be that the City Council observe the <br />restaurant operation for at least a couple of months and then call a public hearing so <br />that neighbors can report on their experience with this business. The City Council also <br />has the option either now or later of granting a license for beer only or beer and wine as <br />an alternative to a full liquor license. <br /> <br />Ms. Colquitt moved to approve the application with a six-month observation period, <br />before granting a liquor license, and Mr. Munkel seconded the motion. <br /> <br />The applicant, Tammy Romer, said she has a good history of serving alcohol. Ms. <br />Welsch said she preferred offering a three-month's beer and wine license and will vote <br />against the measure before the Council. Mr. Wagner suggested an amendment to the <br />provision allowing six month's observation and allowing the serving of wine. Mayor <br />Adams explained that a liquor license is issued, or it is not; there is no temporary liquor <br />license. Mr. Wagner supports a beer and wine license to start. Ms. Welsch moved to <br />amend Councilmember Colquitt's proposal by offering a three month's wine and liquor <br />license as opposed to a six month period with no liquor license. Mayor Adams <br />explained that according to the law of the State of Missouri, it is not possible to attach a <br />time-frame to a beer and wine license; one is issued or it is not. Instead, the caveat <br />would be, after a reasonable amount of time and if the Council feels it is justified, the <br />applicant can return with or without prejudice to apply for a full liquor license. Mayor <br />Adams reviewed parliamentary procedure with Ms. Welsch, who then amended Ms. <br />Colquitt's motion to allow this applicant to have a beer and wine license immediately. <br />Mr. Wagner seconded the motion. <br /> <br />Ms. Colquitt did not accept Ms. Welsch's amendment as friendly.
