Session 1911 <br />February 9, 2004 <br /> <br />fears negative impact on this space. Mr. Lieberman seconded the motion. <br /> <br />Mayor Adams restated the motion and indicated that no further discussion is allowed. <br /> <br />Mr. Wagner raised a point of information. He asked about maintenance of the paved <br />property by the owner and wondered if the City would incur any expense. He was <br />advised that if approved, the owner would assume this responsibility. <br /> <br />Following a unanimous vote, the proposal was postponed. <br /> <br />Mayor Adams asked if the City Manager would find out if this property were to be used, <br />what guarantees were there against adverse possession of said property. Mr. <br />Lieberman commented that it could happen. <br /> <br />AGENDA ITEM #5 - 8324 Olive Conditional Use - Auto Repair <br /> <br />Mr. Ollendorff agreed with the Plan Commission majority recommendation that approval <br />be given to expand the vehicle accessory parts, installation of car stereo, and detailing <br />business by adding automotive repair services. At least one neighboring business <br />opposes while several others are in favor. All ordinance requirements are met and <br />detrimental effects on the neighborhood will be avoided if conditions include the <br />following: repair and installation services must take place inside the building; no noise <br />or audio beyond the property lines; and overnight parking limited to six licensed <br />vehicles. City Council may wish to add a limitation on hours of operation as has been <br />done for some automobile related businesses, in order to avoid undue neighborhood <br />disturbance at unreasonable times. <br /> <br />Ms. Welsch questioned how noise will be dealt with, and whether or not there were six <br />parking spaces behind the building while leaving the alley open for others to use. Mr. <br />Sharpe said his understanding was that there were to be six parking spaces. Mr. <br />Wagner asked if the only optional condition was limiting the hours of operation. He <br />asked what their current hours of operation were, and he was advised by the City <br />Manager that they could not open before 7 a.m. and needed to close by 8 p.m. He said <br />there is no standard rule. Mr. Ollendorff said he raised the issue of limiting hours <br />because the City Council had done so in the past. <br /> <br />Alvah Levine, 8630 Delmar Boulevard, the architect for the tenant, said he could answer <br />technical questions about the plans. There are two bays of a four bay, multi-tenant <br />commercial building, with each tenant separated by a full-height partition. The partition <br />is not being changed. Parking included is more than adequate to meet requirements. <br />Parking behind the building is not visible from the street. The tenant's hours of <br />operation are 8 a.m. to 6 p.m. While they do some work over extended hours, they do <br />not serve customers at that time. <br /> <br />Page 5 <br /> <br /> <br />
