“PD” – Planned Development District; and 34-88.3(3) “District Standards” in the <br />Olive Boulevard Historic District”; thereby amending said chapter so as to add <br />provisions on the Olive Boulevard Design Guidelines for new development and <br />substantial redevelopment along Olive Boulevard; containing a savings clause <br />and providing a penalty. <br />Introduced by Mr. Wagner <br />3. BILL 9016 - An ordinance amending Chapter 34 of the University City <br />Municipal Code, relating to zoning, by repealing section 34-123.1 thereof <br />relating to City Council review of site plans and Section 34-132.2 thereof <br />relating to Plan Commission findings of facts for conditional use permit <br />approval, and enacting in lieu thereof new sections to be known as "34- <br />123.1 City Council Review”; and "34-132.2 Findings of Fact", thereby <br />amending said section so as require that all new development and <br />substantial redevelopment along Olive Boulevard reviewed under a site <br />plan or a conditional use permit process comply with the Olive Boulevard <br />Design Guidelines; containing a savings clause and providing a penalty. <br />L. CITIZEN COMMENTS <br />Jan Adams, 7150 Cambridge Ave <br />Ms. Adams identified herself as a new member on the Civil Service Board. She had <br />a question of the Council concerning who she would address from the City about <br />any legal matters she as a member of the commission might have. <br />Mr. Price and Mayor Adams suggested that any legal questions should be handled <br />by the Chair of the commission. Ms. Adams stated that because the commission <br />had not met for a long time, there was no clear member that could be identified as <br />the Chair. Ms. Ricci stated that in the Municipal Code, Chapter/Section 2.12.020 <br />stated “The City Counselor shall have charge of all litigation in which the City is a <br />part; represent the City in all legal matters and proceedings in which the City is a <br />party or interested, or in which any of its officers are parties in their official capacity; <br />advise the City Council or any committee or member thereof, and the heads of all <br />departments, and all other officers and agencies of the City as to all legal questions <br />affecting the City’s interest; and approve as to form all ordinances, contracts, deeds, <br />bonds, and any other documents to be signed in the name of, or made to or with, the <br />City.” She stated that Ms. Adams had the authority to contact the City Attorney, but <br />since the attorney present at the Civil Service Board was Special Counsel, it was not <br />clear as it was not approved by the Council. Ms. Ricci stated that according to <br />Section 2.12.030 “Special counsel may be employed by the City Manager with the <br />consent of the Council to perform any necessary legal services for the City; <br />provided, however, that the City Manager whenever he or she deems it necessary or <br />advisable to do so, may employ special counsel to represent the City in matters in <br />the City court or circuit court of the county, on appeals from the City court, and pay <br />such compensation therefore as may be agreed upon within the limits of the budget <br />appropriation.” She felt that Council and Mr. Mulligan would need to discuss use of <br />Special Counsel. Mayor Adams disagreed with Ms. Ricci’s interpretation. Mayor <br />Adams told Ms. Adams to forward her letter to the staff and they would give her <br />disposition as to what is happening. Ms. Ricci wanted the City Clerk to record for <br />the record that 2.12.020 specifically states that a member of a commission has the <br /> <br />
