Session 1718, Minutes
March 30, 1998

number. Mr. Gold replied that the station hours for gas is 6 a.m. to 9 p.m. There will be
somebody there that will be able to take the cars. There will be a drop slot with an
envelope for instructions and keys. Mr. Gold said he did not anticipate it going over six
cars. It will be hard to control, but it will be maintained.

Mr. Schoomer asked who the owner was of the area beyond the fence. The applicant
stated that Sinclair owns it. Responding further to Mr. Schoomer, the applicant said
that it was their understanding that the City did not want them to park cars back there,
but if they want them to park them there now, they could do so. Mr. Sharpe did not
believe the citizens would like that idea. The applicant agreed. The applicant stated
that if the overflow happened it would be in the morning during drop offs, rarely in the
evening, because most people do not like their vehicles left out overnight with no
protection.

Mr. Munkel moved approval with the conditions set forth by the Plan Commission. Mr.
Ware seconded the motion. All voted Aye, except for Mr. Sharpe, who voted Nay. The
motion passed six to one.

AGENDA #5: CONDITIONAL USE PERMIT - TELECOMMUNICATIONS TOWER,
ANTENNAS, AND EQUIPMENT BUILDING:

Mr. Ollendorff concurs with the Plan Commission's recommendation to approve the
Conditional Use Permit for a telecommunications tower and antennas and equipment
building subject to the following conditions: That a detailed landscaping plan be
submitted to the director of planning for his review; the landscape material shall be
installed and shall be maintained in accordance with the site plan. He further concurs
with the Plan Commission's findings in their consideration of this matter. The
Commission's findings should be considered during Council's deliberation on this issue.

Mr. Douglas Baron, 10 South Broadway, reported that the applicant did not wish to
respond at this time. Recent developments in regard to this particular site has caused
the applicant to wish to remove this item from consideration this evening and delay it
until the next meeting. Mr. Ware said that he received a call from Roosevelt and Evelyn
Ervin whom had received a letter from the Plan Commission. They were not able to
come tonight and told Mr. Ware to speak on their behalf. The letter indicated that
everyone in that area, within 185 feet would be notified. The letter stipulated that in the
event that some of the neighbors did not get the letter, to notify them. Mr. Ware felt that
this should not be up to these people to inform their neighbors and that all of the
affected neighbors should have received the letter.
