Session 1935
September 27, 2004

Mr. Ollendorff advised the Council that the only subject before them tonight was
whether this plat complies with the technical requirements of the City Ordinance; the
question is not whether it is a good plan, but whether it meets the City Code. The next
step in approval of the plat is for any member of Council to request that a bill or
ordinance be prepared for introduction. If one is received, the bill will be prepared and
introduced at the next City Council meeting, subject to a vote three weeks thereafter at
the following City Council meeting. He advised that the Plan Commission reviewed this
proposal and listened to citizens' comments at two public meetings. A motion to
approve the plats failed by a vote of 2 - 4 at that meeting. Every piece of information
submitted and relating to this issue has been provided to members of the City Council.

George Hinkle, 541 Warder Avenue, said that while some suggestions meet all the
technical requirements they are just bad ideas and this is one and he opposed it.

Julie Harig, 7814 Greensfelder Lane, asked the Council to respect the unique
characteristics of the Lane and to leave it as it is.

Tom Harig, 7814 Greenslfelder Lane, commented that it was ironic that he was arguing
against the construction of costly homes on his street and then asked the Council to
consult the document he brought with him: "Greensfelder Lane Association: Prevailing
Patterns," which addresses the crux of his objections - frontage dimensions and set-
back and how these issues will change the features of the street. Property lines will
also change, changing the look of the street by introducing a unique feature to the
prevailing pattern. He regards changes as unfair to homeowners on Greensfelder. Mr.
Harig also raised his objection to the applicant meeting privately with the Zoning
Director during the course of a Plan Commission meeting over the subject of a delay
rather than posing his question in public.

Bob Wagoner, 7848 Greensfelder Lane, expressed his objection to this plan as
"incompatible" with the Comprehensive Plan and state of the neighborhood, which he
believed University City was dedicated to upholding. This proposal does not meet the
requirements to sustain the current character of Greensfelder Lane so he is opposed to
it.

Jeff Weintrop, 7832 Greensfelder Lane, opposed the design on behalf of the rain water
and storm water issues, which affects the neighbors next to the area of the proposal, by
removing the surface into which rainwater is absorbed, resulting in more damage to
property.

Lori Shifter, 7832 Greensfelder Lane, mentioned several points in opposition to this
plan, voicing her concerns about how this plan will violate the integrity of the private
street and her desire to maintain the comprehensive plan for the neighborhood.

Page 8
