Session 589, Minutes
February 1, 1960

Page 4

operate the home in the present manner, but does object to any enlarged
scale of operation.

~r. Harry Raven, 722 Kingsland Avenue, upon being recognized, spoke in
opposition to the proposed home. He called attention to the congested condition
in the rear of the property and to the number of trucks passing through the
abutting alley and also to lack of parking space. He stated that it would be
impossible for the persons living with Mrs. Kramer to cross streets in order
to attend religious services, unless they were attended by someone.

Mr. Marshall Arky, 714 Kingsland Avenue, asked to be recognized, which request
was granted. Mr. Arky indicated he is opposed to the granting of a conditional
use permit.

Upon inquiry by Mayor Kaufman, there appeared to be no other members of the pub-
lic who wished to be heard on this subject. The Mayor then asked whether any
member of the Council had any questions, whereupon Councilman Tandler address-
ing himself to Mr. Ackert, inquired as to the number of people that Mrs. Kramer
anticipates will reside with her. Mr. Ackert again came forward and explained
that what he intended to convey earlier was that Mrs. l(ramer had indicated she
would like to have a place for twelve, which would be the maximum figure;
however, he said, that is not a fixed number and it will probably be consider-
ably less. Answering another question by Councilman Tandler, Mr. Ackert ex-
plained how the applicant intends to use the first and second floors of the
building in question. He also stated there will be no signs on the outside of
the building.

In reply to inquiry by Councilman Soule as to whether the Fire Department has
made an inspection and set out what will be necessary as far as the City's
ordinances are concerned, City Manager Henry stated the administrative forces
have received a report and copies will be transmitted to members of the
Council.

Mayor Kaufman declared the public hearing concluded at 8:42 o'clock P.M. and
stated that the Council would take the matter under advisement and in due time
will reach a decision.

APPLICATION FOR A CONDITIONAL USE PERMIT FOR A GASOLINE DISPENSING SERVICE
STATION AT KING KARWASH .(OLIVE BOULEVARD A~ G?J~NT DRIVE):
This matter was reviewed by the City Manager. He pointed out that at a meet-
ing of the City Plan Cormnission on December 23~ 1959, that body, by a vote of
7 to 0, disapproved an application made by Mr. Jacob Rudin for a gasoline
dispensing service station at King Kar Wash on Olive Boulevard and Grant Drive,
for a number of reasons, as set forth in a letter from the City Plan Commission,
dated January 4, 1960, copy of which is attached to agenda item number 2.

The City Manager stated that a public hearing has been scheduled for this
evening with reference to this matter. Mr. Sheldon Weinhaus, attorney repre-
sening the applicant, asked to be recognized, which request was granted. He
informed the Council that he, and the firm with which he is associated, also
represent the area wide distributor of Lion Oil Products although he is not
appearing tonight as their counsel or representative.

Mr. Weinhaus stressed that the applicant intends to dispense gasoline in con-
nection with his car wash operation and does not contemplate operating a
