Session 1938 <br />November 1,2004 <br /> <br />Ms. Welsch said that she understood the "density issue" but was not sure that she <br />understood the "open spaces" aspects and asked if the addition of the phrase <br />"residential district" was the only change made. Mr. Ollendorff said he understood that <br />is provision gave the Plan Commission and the City Council, ultimately, some limited <br />flexibility in applying the open space requirements. Currently, the requirement is very <br />strict. This new measure allows the matching of the neighborhood to transfer space <br />requirement from multi-family areas to office areas, or vice versa, resulting in more <br />flexibility in the district and things can now be relaxed with good reason. Next Ms. <br />Welsch asked if a certain shape was required or if the square footage could be spread <br />throughout the development and Mr. Ollendorff advised that he would obtain specific <br />information to answer her question. She commented that the strike-thrus and <br />replacement text were difficult to follow and asked that the changes be more <br />understandable in the future. <br /> <br />Ms. Brot thanked Mr. Ollendorff for his help to her to expand her comprehension of the <br />differences between the original document and the revised one. She asked also if <br />copies of the specific item from the Zoning Code could be disseminated to <br />Councilmembers and was advised that it could be done. <br /> <br />6380 Delmar- Conditional Use Permit <br /> <br />Mr. Ollendorff said he was pleased to recommend approval for a Ben and Jerry's "in the <br />Loop" subject to conditions including: hours of operation from 11:00 am to 11:00 p.m., <br />seating limited to the approved plan, and compliance with city codes regarding signage, <br />litter control, refuse disposal systems and, if necessary, installation of an exhaust <br />system to control odors from food prep. The Plan Commission concurs with these <br />recommended conditions. <br /> <br />Councilmember Brot expressed her delight at the advent of Ben and Jerry's to <br />University City, but asked if the location was too small. Mark Heller, the owner, shared <br />some details relating to the decision to locate in The Loop and about the advent of this <br />company to the St. Louis area, pointing out that this would be the first of a series <br />opening and commenting that Ben and Jerry's and University City are like "peanut <br />butter meeting jelly." He mentioned both the "soft opening" to occur in two to three <br />weeks and the "grand opening" to be held at a later date. <br /> <br />Councilmember Colquitt moved approval and Ms. Welsch seconded the motion which <br />passed unanimously. <br /> <br />Heman Recreation Facility Fees <br /> <br />The City Manager concurred with the Park Commission recommended schedule of fees <br />and charges for the Heman Recreation Facility Complex, effective December 1, 2004. <br />All of the fees are based on the facility pro forma completed in April per City Council <br /> Page 4 <br /> <br /> <br />
