Session 868, ~nutes <br />June 19, 1967 <br /> <br />Page 16 <br /> <br />track of everyone operating in this City and I think the word should remain <br />"shall." <br /> <br />Councilman Epstein said she doesn't think it would mean they won't do it <br />if the word is changed to "may." <br /> <br />Councilman Bamburg pointed out that the State publishes a list of licensed <br />real estate brokers and salesmen and anyone of them in the area could well <br />be selling a house or operating in University City so with that list which <br />does not contain thousands and thousands of people "you can get an idea of <br />who might be operating here..." <br /> <br />Discussion continued as to the number of agencies and Councilman Bamburg <br />again pointed out they are all listed in the one publication which is <br />available, free of charge. <br /> <br />1,~yor Kaufman said he thinks there was a suggestion by Dean Lesar to <br />possibly change Section 2 (a) to substitute the word "may" for the word <br />"shall" and the Mayor inquired as to the pleasure of the Council. <br /> <br />Councilman Lieberman said he thinks Dean Lesar made the same recommendation <br />as Councilman Epstein, whereupon Councilman Epstein said her suggestion <br />was based on Dean Lesar's. }~yor Kaufman asked whether this means both <br />(a) and (b) and Councilman Lieberman said it means subsection (b) only. <br /> <br />Councilman Woods said she would like to support what Councilman Lieberman <br />has said. (See below) <br /> <br />RECESS: <br />At this juncture, 9:34 P.M., Mayor ~aufman announced a brief recess and <br />at 9:39 P.M. the Council reconvened. <br /> <br />BELL NO. 6403 (AS ~tENDED). Continued: <br />Councilman Woods said that during the recess there was some discussion <br />about the use of the word "may" or "shall" and she had Just finished ex- <br />pressing herself to the effect that her main concern was - the reason <br />why she thought perhaps it ought to be "shall" - was because the Council <br />wanted to be mute it was done but this may again be a case "of if we say <br />it shall be done it may end up with all of the time of the people involved <br />being spent on keeping lists rather than imposing the real guts of this <br />Bill, so I would see some advantage perhaps to leaving it "may" but try- <br />ing to see that in administration we do keep in touch with the real es- <br />tate people." <br /> <br />Mayor Kaufman said there is a motion on the floor and if Councilman <br />Lieberman is willing to accept the recommendation it can be incorporated <br />in his motion, and the Mayor explained he is referring to the change <br />from "shall" to "may" whereupon Councilman Lieberman indicated he is <br />willing to accept the suggestion. The Mayor said this then becomes part <br />of Councilman Lieberman's motion. <br /> <br />Councilman Epstein seconded Councilman Lieberman's motion and upon vote <br />it was unanimously carried. <br /> <br />Mayor Kaufman pointed out that the City Counselor has ruled that this is <br />not a substantial change. <br /> Continued, next page <br /> <br /> <br />
