He thanked Councilmember Brot for catching this <br />error. <br /> <br />Picnic Beer License- 7148 Forsyth <br /> <br />Mr. Ollendorff recommended approval of a license to sell beer at a special event held at <br />Our Lady of Lourdes on November 19, 2004. This organization has successfully <br />sponsored similar events in the past. <br /> <br />Councilmember Wagner moved approval of the Consent Calendar and Ms. Welsch <br />seconded, and the motion was approved unanimously. <br /> <br />The City Manager then introduced a recommendation from the Plan Commission to <br />approve a: <br /> <br />Marquee Si,qn Conditional Use Permit at Blueberry Hill <br /> <br />The Plan Commission recommended approval of a conditional use permit for a 14 foot <br />high marquee sign rising 25' above street level above the Blueberry Hill awning. This <br />represents a major extension of the sign ordinance opening the door to at least four <br />additional similarly sized signs in the U. City Loop. Mr. Ollendorff concurs with the <br />recommendation as for the Council believes that such a stretching of the definition is <br />within the intent of the ordinance either the applicant accepts conditions that there be no <br />further identification signs attached to this building, that copy be provided noting events <br />in the places of assembly, and that there be no moving/changing/flashing/fading lights. <br />That seems to Mr. Ollendorff that the sign ordinance should only be stretched so far <br />before it will be broken as far as enforcement is concerned. The sign that was <br />proposed is well designed and distinctively appropriated for Blueberry Hill and the <br />University City Loop. <br /> <br />Mr. Ollendorff noted that this request does stretch the definition of marquee signs, by <br />expanding approval from the Tivoli Theatre to any place where there are public <br />gatherings to watch or to listen to amusements. If this interpretation is approved, there <br />could be other sites included in the University City Loop. <br /> <br />Ms. Welsch moved approval and Ms. Colquitt seconded. <br /> <br />Ms. Brot commented that what the City Manager recommended is different from the <br />recommendation posed by the Plan Commission. Instead of Mr. Ollendorff's statement, <br />she wants to approve the submission of the Plan Commission, which included the use <br />of gentle, fading lights He responded that it is Council's prerogative to do so. Mr. <br />Wagner asked if there was a condition but Ms. Brot was unsure how to proceed with her <br />request. She was advised by other members to amend the recommendation of the City <br />Manager to coincide with all the items recommended by the Plan Commission, including <br /> Page 3 <br /> <br /> <br />
