Session 1939 <br />November 15, 2004 <br /> <br />Greensfelder Lane, and referred to previous interaction with both the Plan Commission <br />and with the City Council, at which they submitted their concerns about plans for <br />building on that street. One is about Greensfelder Park. He referred to a legal <br />document issued in 1930 and relating to the rear portion of Greensfelder Lane which is <br />meant to be known as "Greensfelder Park" and stating that it is not to be altered or <br />divided or used for any other purpose. Mr. Greenwood asserted this provision has not <br />been explored sufficiently by people undertaking the change. There is and continues to <br />be a restriction included on deeds stating that the rear lots must be subject to <br />reservation as use of a park according to the instrument recorded in Book 1119, page <br />97. All former property owners, prior to Mr. Anselmo the current property owner, have <br />the 'park restriction' on their deeds. These restrictions are valid and recorded in Saint <br />Louis County records and this restriction remains in place. He further commented that <br />Chapter 1612-010 of Major Subdivisions refers to parks. His group, therefore, submits <br />that due to this Greensfelder Park restriction, the request to subdivide 7823 <br />Greensfelder Lane falls under these rules and procedures, and he requests that this <br />restriction be fully and legally deliberated. He then gave the document he presented to <br />the City Clerk. <br /> <br />Mr. Wagner commented that Mr. Greenwood submitted an important document and <br />said that consideration, not previously covered adequately at the Park Commission, <br />needs to acknowledged now that park land is involved and that consideration puts this <br />request into a new category for review. He also noted the need to find out why Mr. <br />Anselmo is not held to the same requirements and restrictions as other residents on <br />Greensfelder Lane. He called for more legal review. Mayor Adams corrected Mr. <br />Wagner and said it would involve review by the Plan Commission and not the Park <br />Commission. <br /> <br />Mr. Wagner also called for the Plan Commission to review the City Code to determine <br />the definition of a "minor subdivision." He believes this review is necessary to afford <br />neighborhoods more protection.
