Session 1939
November 15, 2004

steps to pursue. One of those was a general, area-wide education program on the
meaning of cross-walks, and that one involved work with the County Municipal League.
They, in turn, recommended to East West Gateway that it be a major part of their
pedestrian safety campaign and East West Gateway recently advised the City it would
become part of their efforts. Ms. Brot then said if light-timing is not lengthened at
Kingsland Avenue, if there will be an increased number of people turning left and if it will
be more dangerous, especially at certain times of day. Mr. Wagner suggested that the
County's suggestion of opening the gates at Kingsbury Boulevard could alleviate some
of the congestion on Kingsland Avenue.

Mr. Ollendorff said the ordinance needed to be amended to add the word "through" at
appropriate places and that the City Clerk had been advised of the appropriate wording
for this document. Mr. Wagner moved to amend and Mr. Sharpe seconded. The
amendment was passed unanimously and the City Clerk will make the changes.

It was decided to hold this Bill over again until the next meeting on December 6, 2004.

BILLS FOR SECOND AND THIRD READING:

BILL NO. 8741 - APPROVING A FINAL SUBDIVISION PLAT OF A TRACT OF
LAND TO BE KNOWN AS "8042, 8100 AND 8104 DELMAR CONDOMINIUM"
AND LOCATED AT 8042, 8100 AND 8104 DELMAR. (Held over from 11101104)

Mayor Adams said that before this bill was read again he wanted to entertain a motion
to defeat the bill because the applicant has decided to not proceed. Ms. Brot moved to
defeat and Ms. Colquitt seconded. The Mayor said a motion of AYE is to defeat. The
roll call vote was a follows: AYES: Ms. Colquitt, Ms. Brungardt, Mr. Wagner, Ms. Brot,
Ms. Welsch, Mr. Sharpe and Mayor Adams; NAYS: none. The motion passed
unanimously. Bill number 8741 was defeated.

BILL NO. 8744 AMENDING CHAPTER 34 OF THE MUNICIPAL CODE,
RELATING TO ZONING, BY REPEALING SECTION 34-40.7(3) AND SECTION
34-57.4(B) THEREOF RELATING TO DENSITY IN THE PD DISTRICT AND
RELATING TO COMMON OPEN SPACE IN THE PD DISTRICT, AND
ENACTING IN LIEU THEREOF NEW SECTIONS TO BE KNOWN AS SECTION
34-40.7(3) PLANNED DEVELOPMENT - RESIDENTIAL (PD-R), AND AS
SECTION 34-57.4(B) SO AS TO ALLOW FOR DISCRETIONARY COMMON
OPEN SPACE REQUIREMENTS IN THE PD DISTRICT; CONTAINING A
SAVINGS CLAUSE AND PROVIDING A PENALTY.

The Bill was given its second reading.
The Bill was given its third reading.

Ms. Welsch moved to adopt and Ms. Brot seconded.
Page 8
