Session 1725, Minutes <br />June 8, 1998 <br /> <br />job of maintaining the exterior in the future. Many neighborhood residents have signed <br />a petition opposing this license with concerns about security, traffic, noise and other <br />activity disruptive of the neighborhood peace and quiet. The applicant indicates that he <br />wishes to be a good neighbor and cater to the neighborhood more than to outsiders. <br />Following the public hearing which is scheduled for this time and place the City Council <br />may grant the license, deny the license, table for further observation or grant a lower <br />level license such as beer and wine. The application is in order, however, the City <br />Council must determine whether granting a license at this location is in the best interest <br />of the community as well as the applicant. <br /> <br />Lula Dempsey, 6815 Roberts, said that a letter stating their (owners on Roberts and <br />Raymond Streets) reasons why they were opposed to a liquor license at this facility was <br />sent to the City Manager and should have been copied to the City Council, so she <br />would not restate them. She and her neighbors look out onto the back of this facility <br />and see debris, uncut grass and mattresses. The City has had to go out and cut the <br />grass around the property, because the owner will not do it. She is opposed to the <br />liquor license, because of the type of patrons it will bring into the community. <br /> <br />Amy Sneirson, 7733 Forsyth, represents 1255 Ferguson as attorney. She stated that <br />the restaurant "This Is It" has been opened as a restaurant since February 1998. They <br />have not been aware of any complaints from the neighbors besides those being heard <br />tonight. There have been no known meetings with the neighbors to address and work <br />on concerns nor have there been any conflicts with the police. The restaurant's profits <br />are too low, and they will not make it without a liquor license. The restaurant is geared <br />toward older customers and not to the young. None of the concerns heard so far, <br />should prevent the Council from approving an unrestricted liquor license. <br /> <br />Lee Tyson, 7347 Trenton Ave., said that he favors Mr. Montgomery opening the <br />restaurant. He said that Mr. Montgomery serves older patrons and not younger, louder <br />ones. He believes that he is a credit to University City and the Third Ward. <br /> <br />Joyce Montgomery, 1255 Ferguson, is co-owner of the restaurant and wife to the <br />applicant. She said that she had sent letters out to the neighbors inviting them in to <br />discuss their concerns, but no one came in to meet them. She said her husband was a <br />steady, well respected family man. They have met good friends in the neighborhood <br />that support them. She does not understand why the neighbors criticize them so much, <br />when they have not taken the opportunity to talk with them in person. <br /> <br />John Cross, 6847 Raymond, is in favor of the restaurant. He believes that he should <br />have an opportunity to run his restaurant and not be blamed for others mistakes in the <br />past. He does not remember ever having to come in and speak about a liquor license <br />at this location in over thirty years. He asked that Council be fair in their decision. <br /> <br /> <br />
