Mrs. Bush said those
using the walkway have come into her yard and stolen items from the porch and
yard. She also felt it was dangerous at night because there is no light. Mr.
Bush said youngsters gather in the walkway at night and make a lot of noise.

No one else came fotward, and the Mayor closed the public hearing at 7:41 p.m.
Mr. Schoomer asked that a bill vacating this walkway be prepared.
Mr. Ollendorff said after the ordinance is approved, he will serxi a copy to
the adjacent property owners.

<X>NDITIONAL USE - 7350 FORSY'IH

'!be City Manager said the applicant who wishes to open a pizza restaurant at
7350 Forsyth has again requested a delay of several weeks. Mr. Ollendorff,
while noting the Plan Commission's favorable recommendation, suggested that a
restaurant at this location is not a use that will contribute to the connnuni-
ty welfare, convenience, property values or area parking solutions. In addi-
tion, odors and noise would detract from the quality of life for residents in
this building as well as neighbors. He observed that the applicant has a
successful store in University City on Olive, and he should be encouraged to
fin:} another, m:>re suitable location in the camnunity.

Mr. Adams m:wed denial, with Mr. Wagner secoming the motion.

Ms. Teresa Wetzel, 7331 Northmoor, presented a 65-signature petition which
asked that Council not allow the proposed restaurant at 7350 Forsyth. She
said there were approximately 50 children living nearby who would be enjan-
gered by traffic generated by the restaurant, and that traffic was already
congested because of the adj acent camrnercial establishments and apartment
buildings. She pointed out that any unusual event in the area, i. e., the
Book Fair, resulted in large amounts of overflow parking on Northmoor. She
said .there was silllply not enough parking for .this restaurant.

Mr. Michael Kahn, 7364 Northmoor, said he was also extreJrely concen1€d about
the traffic problems the proposed restaurant would cause. He circulated a
map that showed the traffic pattern, commercial establishments, etc. in the
area, and pointed out how few parking spaces there are and the difficultY of
leaving the proposed restaurant site except by using Northmoor.

Mr. William Monahan, 7265 Northmoor, said good points were made regarding the
increased traffic that would result from the proposed restaurant, however,
not mentioned was the probability that the pizza delivery drivers will use
Northmoor to exit the restaurant site, thus endangering the neighbo:rhood
children. .

Mr. Schoomer agnm the site was not a good restaurant location, however, he
strongly encouraged the applicant to seek another locale in University City.

All voted Aye except Mrs. '!hompson, who voted Nay.
