CONDITIONAL USE PERMIT - 8333 FUUERION/aroRaI DAY CARE '!he City Manager said he concurred in the Plan Carrmission recornmerrlation that the city Council approve a conditional use pennit for a child day care center at 8333 F\1l.lerton to be operated by the Aburrlant Life Center Church, with the following conditions: 1. Signs on the premises shall confonn in all respects with the provisions of the University City Sign Code. 2. A detailed landscaping plan shall be submitted to the Director of Plan- ning for his review and approval. landscaping shall be installed and maintained in accordance with the approved plan. 3. '!he child day care use approve1 under this pennit shall be also approve1 and licensed by the state of Missouri Deparbnent of Family Senrices. Oc- cupancy shall be tenninated by the City if state approval or licensing is withdrawn for any reason. 4. Children shall be delivered into and picke1 up from inside the building by an adult parent or guardian. 5. The use pennit is liInited to operation of a day care center in conjunc- tion with church operations at this location by the Aburrlant Life Center Church. Operation of the center without a full church operation on the premises or operation by any other owner or operator with the express ap- proval of the City Council shall render the pennit and the occupancy per- mit for the business null and void. 6. '!here shall be no increase in the area of the building devoted to day care without the express approval of the city. Mr. Adams moved approval, including all conditions. Mrs. '!hompson secorrled the motion. Mrs. Thompson asked if the church agreed with all conditions. Rev. Samuel Earl came forward, and said the church would ccmply with all conditions. Mr. Schoamer thought pe:rl1aps Council should not require a state license, but siIrply ask that the use confonn to state standards and reco.mmerxi that a li- cense is the siIrplest way to do that. Mayor Majeros said requiring a state license has been done in the past and has not created a problem. Mr. Adams agreed, noting that although religious institutions are not require1 to have a state license, he felt all institutions that offer day care should be li- censed by the state. ~ Mrs. Schuman said the site plan shows an outside drop-off circle, but Condi- tion #4 says children will be picked up and delivered from inside the build- ing.
