RJBLIC HEARING - ZONING roDE DEFINITIONS '!he City Manager said a public hearing was scheduled for 7:30 p.m. this date and place to consider conunents on the Plan Conunission proposal to amend the Zoning Code by adding definitions for corwalescent home, nursing home, hospi- tal, donnitory, and substance abuse treatment center. Mayor Majerus opened the public hearing at 7: 36 p.m. '!here were no requests to speak, and the Mayor closed the public hearing at 7:36 p.m. She asked. that a bill containing the proposed changes be prepared. SI'IE PIAN - 7828 OLIVE STREEI' ROAD councilmember Schoomer left the Council chambers. '!he City Manager reconunended approval of a new site plan and transfer of li- quor licenses for the Bar Jamaica Restaurant from its original location in the Westover Center to a new location farther east in the same complex. '!his will provide almost twice as much floor space for the restaurant as well as a large stage area. Approval should include the following conditions: 1. '!he ilnpact of live entertainment on parking arx:i other Center facilities shall be monitored by the City, arx:i the o:perator shall hereby agree to restrict or eliminate live entertai.nment from the restaurant operation if the City detennines that it causes a negative impact on parking and other Center facilities. 2. Parking behind the building shall be limited to employees only. 3. A detailed landscape plan for the area between the building, Mount Olive Avenue, and Groby Road shall be submitted to the Director of Planning for his review and approval. Landscaping shall be installed and maintained in accordance with the approved plan. 4. '!his permit indicating the City Council's approval of site Plan Review #1245 is limited to Mrs. Albertine '!hompson doing business as Bar Jamaica Jerk pit. Operation of any other restaurant or bar or o:peration by a different proprietor will cause this permit to become null and void. Mr. Price moved approval of the site plan with all conditions. Mr. Wagner seconded the motion. Mrs. Schuman was concerned whether employee-only parking behind the building could be enforced, and also if that area will be landscaped prior to occupan- cy. Mr. Ollendorff said the City was not requiring landscaping before occu- pancy since the restaurant was anxious to move in, but it would be appropri- ate for Council to establish a date for completion. Responding to Mrs. Schu- man, Mr. Ollendorff said the City was making the restaurant operator respon- sible for landscaping, but she will ask the Center owner (C-4) to do the work.
