Should the City fllrl that the installation has a negative effect on radio <br />or television reception or the health of people in the vicinity of the <br />tower, it shall give notice of its firrlirg to the applicant; anj if after <br />a period of six m:mths the City firrls no significant iIrprovement, this <br />pennit shall become null anj void anj the applicant shall cease operation <br />fram this site anj remove the tower anj all equiprrent fram the site. <br />2. In the event the applicant stops usirg the tower anj equiprrent for a per- <br />iod of 12 nonths, the applicant shall remove stnlctures anj equiprrent <br />fram the site. <br />3. I.andscapirg shall be maintained in accordance with the revised plan sub- <br />mitted. <br />4. '!he 22 I wide strip of lanj between this applicant I s property anj Eastgate <br />Park shall be cleared of rubble anj debris, seeded anj then maintained by <br />this applicant until such ti1ne as it is developed by another applicant. <br /> <br />Mrs. Schuman noted that the Park Commission has a long-stan:iirg request that <br />any proposed use of sites adjoinirg public parks should be discussed by them <br />before Council approval. since this site adjoins Eastgate Park, she lOOVed <br />that this matter be tabled until the Commission can discuss this matter. Mr . <br />Schoomer seconded the motion, which carried unanllrously. <br /> <br />OONDITIONAL USE PERMIT - ONE MCKNIGHr PIACE <br /> <br />The city Manager concurred with the Plan Commission that approval may be gi v- <br />en for a corxlitional use pennit for a nursirg home if the applicant agrees to <br />the followirg conditions: <br /> <br />1. A detailed lan:iscapirg plan shall be submitted anj approved by the Plan- <br />nirg Director anj lan:iscaping shall be installed anj maintained in gen- <br />eral confonnity to the approved plan. <br />2. All driveways anj parking areas shall be edged with Portlanj Cement con- <br />crete curbs. <br />3. All exterior mechanical equiprrent shall be effectively screened.. <br />4. sto:nnwater design criteria calculations shall be submitted for review <br />anj approval of the City staff anj MSD; anj a sto:nnwater drainage system <br />shall be installed anj maintained in accordance with the approved plan. <br />5. Fire hydrants shall be installed at loctions approved by the Fire Mar- <br />shall. <br />6. Final driveway anj parking lot layouts shall be reviewed anj approved by <br />the Fire Marshal to ensure there will be adequate access anj maneuverirg <br />space for emergency vehicles. <br />7. The building shall be set back at least ten feet fram the parking areas <br />anj driveway with walls containing patient room wllrlows set back at <br />least 15 feet fram the parking areas anj driveway, except bay wllrlows <br />shall be pennitted to project no nore than three feet into the required <br />setback areas. <br />
