<br />~ <br /> <br />Session 1562, Minutes <br />January 27, 1992 <br /> <br />Page 6 <br /> <br />Mr. Ollendorff said the split vote reflected that this location has been a <br />City eyesore for many years, arxl that previous operators ignored city laws <br />that regulate this kirrl of operation. He said council should be fully satis- <br />fied that the applicant has both the willingness arxl monetary ability to <br />clean up the property arxl keep it that way. <br /> <br />Mr. Adams, noting that similar operations sometimes have not done a good job <br />keeping their premises clean or the nmnber of cars at an allowable level, ex- <br />pressed COnceITl about the City's recourse if the operator refuses to comply <br />with regulations. <br /> <br />Responding to Mr. Price, Mr. Ollendorff said the City can get compliance, but <br />with an unwilling operator it may take some time arxl involve court dates, arxl <br />neighbors often get upset before the conditions are corrected. <br /> <br />Mr. Harvey Feldman, 9660 Olive Blvd., attorney representing the operator, Mr. <br />Feygelrnan, came forward. Mr. Feldman said his client would comply with all <br />conditions, arxl certainly understood that. this site at the east entrance of <br />University city was a sensitive location. Mr. Feldman felt it was not quite <br />fair to transfer negative feelings concerning the previous operation to the <br />new operator, arxl he assured council that Mr. Feygelrnan will keep the site <br />clean. He said the area behirrl the building will be enclosed in some way to <br />discourage nighttime Parking, arxl all automotive work will be done indoors, <br />with no derelict vehicles on premises. Mr. Feygelrnan, 16408 Audubon Village <br />Drive, Grover, came forward arxl said a store selling liquor is next to his <br />business, arxl he often finds liquor bottles arxl other debris on the premises, <br />which he cleans up every day. In response to Mr. Ollendorff, Mr. Feygelrnan <br />said any cars kept overnight will always be kept inside the building. <br /> <br />Mrs. Schuman pointed out the May 1st deadline on several of the conditions, <br />arxl said she will insist strenuously that the work be finished by then. <br /> <br />Mr. Schoomer said the store selling liquor was in st. IDuis, but would be re- <br />ceptive to complaints either to the excise commissioner or the aldennan in <br />that ward. Also, the SPecial Benefit Tax District Board of Directors dis- <br />cussed this matter, arxl there seemed to be consensus that Mr. Feygelrnan was <br />conducting this operation better than the previous operator. <br /> <br />Mrs. Schuman said she agreed with the Plan Corrnnission member who felt this <br />use was not compatible with other retail business in the loop, however, the <br />site has held this type of business for many years. She emphasized that the <br />operation will be watched carefully arxl all conditions strictly enforced. <br /> <br />Mr. Price moved approval with all conditions, but adding another condition-- <br />that the site be policed daily to remove trash, rubbish arxl debris.
