Regular Meeting <br />March 28, 2005 <br /> <br />Ms. Welsch described herself as very supportive of this development but said she would <br />go with the majority of the Council if they acquiesced to Ms. Colquitt’s request to delay <br />this issue to the next Council meeting; she will support that motion. She asserted that <br />she is supportive of Mr. Tsai’s project but she also supports citizen input on new <br />development in their neighborhood. If the notification has not been as successful as <br />she would have hoped, she wants to give the discussion period another two weeks. <br /> <br />Ms. Brot echoed Ms. Welsch and asked some other questions: are the apartments to be <br />rental units and has there been any due diligence research to determine if people want <br />to live there? Mr. Yang said they would be rentals and that a real estate company had <br />been contracted and there is a waiting list of people who want to move in. Ms. Brot then <br />asked if there will be other businesses, other than the dwellings? Mr. Yang replied that <br />in addition to the first floor of the addition, there is a three thousand foot “out-lot” that <br />used to be a Payless Shoe Store that will be updated for additional retail space. <br />Outside of that, the property is not large enough for anything else. <br /> <br />Mr. Ollendorff then suggested to the Council that the administration wanted to advise <br />the developer that the rezoning is approved. That can be accomplished by adopting the <br />ordinance tonight. The administration also wants the developer to know that the basic <br />development concept is more than appropriate and very desirable, and that can be <br />accomplished by adopting the Resolution. They can detain the final step of approving <br />the detailed plan under the conditional use permit. That would allow time for residents <br />to voice their concerns about the detailed plan but would not withhold Council’s official <br />approval of the rezoning and the development concept and would allow the developer to <br />continue with detailed plans, get ready for building permits and would not jeopardize the <br />project at all. It would mean that at the next Council meeting, they could act upon the <br />conditional use permit. <br /> <br />Ms. Brot said she did not understand what the difference was between the Resolution <br />and the Ordinance, which seemed to say the same thing? Mr. Ollendorff said he was <br />not sure he could explain adequately, but under the Zoning Ordinance all three <br />approvals are needed. He is not sure why it is set up this way. <br /> <br />Ms. Welsch said the option outlined by the City Manager would work for her and would <br />allow the Council to get detailed citizen input on the site plan and she supports the <br />suggestion. Ms. Colquitt said she agreed to that as well and then she addressed the <br />developer and said she wanted him to know that she wanted developers who come into <br />the City to have more input from the citizens. <br /> <br />Mayor Adams declared the Public Hearing closed at 6:58 P.M. and asked Mr. Smith if <br />his questions had been answered to his satisfaction, and then he repeated the request <br />from the Council for the developer to get together with the citizens to obtain their <br />comments. <br /> <br />Page 7 <br /> <br />
