Regular meeting <br />August 8, 2005 <br /> <br />34-22 THEREOF, AND ENACTING IN LIEU THEREOF A NEW OFFICIAL <br />ZONING MAP, THERBY AMENDING SAID MAP SO AS TO CHANGE THE <br />CLASSIFICATION OF PROPERTY AT 7733 OLIVE FROM SR – SINGLE <br />FAMILY RESIDENTIAL DISTRICT, TO GC – GENERAL COMMERCIAL <br />DISTRICT; CONTAINING A SAVINGS CLAUSE AND PROVIDING A PENALTY. <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />Mr. Wagner moved for adoption and Mr. Sharpe seconded the motion. <br /> <br />Mr. Ollendorff read from the Zoning Administration’s report regarding the zoning history <br />on 7733 Olive lot. When the applicant originally met concerning expansion of building, <br />zoning was not considered an issue. On closer examination it was discovered that the <br />rear portion of the lot was zoned SR even though it has been used for commercial <br />purposes for as long as anyone can determine. Technically, commercial use on the lot <br />is grandfathered, but in the instance when explanation is involved, the rezoning must <br />occur for conformity. There is no valid reason for the zoning of only the rear portion of <br />the lot to be residential. <br /> <br />Mr. Wagner said the issue here was to correct an error that we haven’t detected <br />previously. We aught to clean up our act and correct the zoning map. This is nothing to <br />do with the proposal for the site. <br /> <br />The Roll Call vote was as follows: AYES: Ms. Colquitt, Ms. Brungardt, Mr. Wagner, <br />Ms. Brot, Mr. Sharpe, and Mayor Adams; NAYS: None. Bill number 8806 passed and <br />became Ordinance number 6575. <br /> <br /> <br /> <br />BILLS FOR INTRODUCTION: <br /> <br />Mr. Sharpe introduced <br />1. AN ORDINANCE APPROVING A FINAL SUBDIVISION PLAT OF A <br />TRACT OF LAND TO BE KNOWN AS 7931-35 DELMAR <br />CONDOMINIUMS AND LOCATED AT 7931 AND 7935 DELMAR. <br /> <br />The bill was given its first reading and assigned bill number 8807 <br /> <br /> <br />Mr. Wagner introduced <br />2. AN ORDINANCE APPROVING A FINAL SUBDIVISION PLAT OF A <br />TRACT OF LAND TO BE KNOWN AS 754 LELAND AVENUE <br />CONDOMINIUMS AND LOCATED AT 754 LELAND. <br /> <br />Page 15 <br /> <br />
