He also noted <br />that additional restrictions have been placed on a person returning to work after retiring on a disability <br />pension; this has been reported to him as being a punitive action. He felt the type of restrictions in the <br />bill were not found in the pension plans of other cities. He asked Council to look at this as well as what <br />types of standards should be met for returning to work. He suggested the bill be tabled until the issues <br />are clarified. <br /> <br />In response to Mr. Munkel, Mr. Ollendorff said the City Attorney has reviewed the bill and it is in <br />keeping with his ruling. <br /> <br />Mr. Wagner 'said Mr. Hepler's letter to Council was well researched, with a balanced approach. He <br />suggested that Mr. Ollendorffadvise Council on three matters: 1) eliminating the wording that reduces <br />disability compensation due to workman's compensation; 2) people on disability who recover--their job <br />may or may not be there; he suggested filling a command position vacated by someone on disability by <br />up to a one year temporary appointment so the person put in that job knows it is temporary depending <br />on whether the injured pe?son can come back to work in a year; 3) standards--help is needed on the <br />definition of standards that cover a returning employee. <br /> <br />Mr. Schoomer said he was very reluctant to debate this on the floor of the Council and felt the proper <br />place would be before the Pension Board, and their recommendation should be binding on the Council. <br />He asked if the bill before Council (No. 8289) meets with the approval of the Pension Board. Mr. <br />Ollendorff said he appreciated the suggestions of Mr. Wagner and Mr. Hepler and will study them; in <br />the meantime Bill No. 8289 should be approved so some of the loopholes may be closed. Mr. Schoomer <br />noted amendments were always possible. <br /> <br />RILLS FOR SECOND AND THIRD READINGS <br /> <br />BILL NO. 8289 - AMENDING CHAPTER 25, SECTION 24 OF THE MUNICIPAL CODE RELAT- <br />ING TO RETIREMENT AND PENSIONS BY CHANGING THE FIRST PARAGRAPH RELATING <br />TO REINSTATEMENT OF FORMERLY DISABLED PENSION BENEFICIARIES INTO ACTIVE <br />SERVICE. <br />Bill No. 8289 was given its second reading. <br /> <br />Bill No. 8289 was given its third reading. <br /> <br />Mr. Schoomer moved adoption. Mr. Wagner seconded the motion. The roll call vote was as follows: <br />AYES: Councilmembers Ware, Munkel, Wagner, Lieberman, Schoomer, Thompson, and Mayor <br />Adams. NAYS: None.
