Session 1679, Minutes <br />September 30, 1996 <br /> <br />Page 5 <br /> <br />Mayor Adams closed the public hearing at 7:50 p.m. <br /> <br />Mr. Schoomer asked that bills be prepared to vacate the properties in Agenda Items 3 and 4. <br /> <br />PUBLIC HEARING - DAY CARE ZONING AMENDMENT <br /> <br />The City Manager said a public heating was scheduled for this time and place to hear comments on a <br />proposed amendment to the "IC" Industrial Commercial zoning district regulations that will allow child <br />care/day nursery as a conditional use. The change is recommended unanimously by the Plan Commis- <br />sion, and is intended to allow consideration of a conditional use permit for King's Child Care Center at <br />848 Kingsland. Following the public hearing, Council may request a bill to amend the zoning text to <br />provide for such a conditional use permit. <br /> <br />Mayor Adams opened the public hearing at 7:51 p.m. <br /> <br />Ms. Carol Mitchell, 1939 Dovershire Court, wished to expand her business and a larger building became <br />available at 848 Kingsland, but day care use was not permitted in the district where the building is locat- <br />ed. She addressed several of the conditions to be imposed by the conditional use permit (following <br />agenda item)--licensing, pick up and drop off procedures, and occupancy/parking issues. She noted the <br />Center has state licensing, strict records are kept for children picked up or dropped off, and the state re- <br />quires a certain amount of parking as well as yard space. In addition, some of her children attend the <br />Early Learning Center across from 848 Kingsland for a half-day, so it would be a convenience for them. <br /> <br />Responding to Mr. Wagner, Ms. Mitchell said there would be 70-80 children attending the new center, <br />and the operating hours are 7 a.m. to 6 p.m. <br /> <br />Mr. Munkel asked about fire safety requirements, and Ms. Mitchell said both the state and city have <br />requirements which the center will comply with. <br /> <br />Mayor Adams closed the public hearing at 7:59 p.m. Mrs. Thompson requested that a bill be prepared <br />with the zoning change discussed above. <br /> <br />CONDITIONAL USE PERMIT - 848 KINGSLAND, CHILD CARE CENTER <br /> <br />The City Manager recommended approval of a conditional use permit for a child care center at the above <br />site subject to approval of the appropriate zoning text amendment, as noted in the previous item. The <br />Plan Commission recommends approval with conditions including compliance with all state licensing <br />standards, child pick up and delivery inside the building, and occupancy limits proportionate to required <br />parking. He said the applicant has an excellent reputation at her present site, and the high-quality care <br />offered would be most appropriate at the new site. <br /> <br />Mr. Wagner moved approval. Mr. Ware seconded the motion, which carried unanimously. <br /> <br /> <br />
