Mr. Lieberman seconded, and all voted Aye. <br /> <br />The applicant, Salim Hanna, 602 Westgate, said he was withdrawing his request for a liquor license. Mr. <br />Lieberman asked Mr. Hanna if he was familiar with the conditions discussed at the Plan Commission <br />meeting. Mr. Hanna said he would comply with all of them. <br /> <br />Mr. Schoomer moved approval with all conditions. Mr. Munkel seconded, and all voted Aye. <br /> <br />LIQUOR LICENSE - 602 WESTGATE <br /> <br />As noted above, this item was withdrawn. <br /> <br />SITE PLAN - 8124 DELMAR <br /> <br />The City Manager said a site plan was submitted for a non-profit office and limited meeting hall use at <br />8124 Delmar, subject to the following conditions: <br /> <br />1. The total number of occupants in the building shall be limited to a total of no more than 24 persons <br /> at any time. The occupancy limit shall be increased to 30 if the applicant furnishes the city staff sat- <br /> isfactory evidence of a recorded perpetual access easement to the rear parking area from the proper- <br /> ty to the west of the applicant's site. The applicant agrees to allow city personnel access to the <br /> building at all reasonable hours in order to monitor the number of occupants present. <br />2. No outdoor functions or activities shall be permitted, except a sukkah shall be permitted to be erect- <br /> ed for the Sukkot festival if located on the west 10 feet of the rear parking area provided the area <br /> is reserved for such use and the rear parking stalls are located 10 feet from the east property line. <br />3. The applicant shall be permitted to use the premises for occasional daily worship services, but use <br /> of the premises for holiday or sabbath worship services shall be considered a synagogue use requir- <br /> ing a conditional use permit issued under the Zoning Code provisions for conditional uses. <br />4. Prior to the issuance of an occupancy permit, the applicant shall stripe the parking areas in accor- <br /> dance with Zoning Code standards. <br /> <br />The applicant, Rabbi YosefLanda, 921 Gay Avenue, said he understood the limitations imposed based <br />on available parking; however, he had several requests. Them was a possibility of obtaining an easement <br />with access to the rear parking lot, and parking areas of neighboring office buildings may also be avail- <br />able in the evening. Therefore, instead of a number, he asked that a ratio be used to allow more people <br />if parking is available. He said his organization, Chabad-Lubavitch, is not a synagogue but provides <br />Jewish education, outreach and social services. They do have educational meetings on Saturday <br />mornings, but not on other days. He did not feel they should have to come back to get permission if they <br />decide to have Sabbath services. <br /> <br />Mr. Ollendorffsaid the restrictions imposed apply to the application as received; also, the easement has <br />not yet been obtained. Mr. Schoomer felt Council should act on the information before them, and he <br /> <br /> <br />
